Item 08B <br />Page 2 <br /> <br /> <br />Plans were submitted by Staff to applicable departments and agencies for review, receiving <br />(most recent) comments from: <br /> <br />• Mike Winfield, Engineering Tech IV, Ramsey County Public Works, December 10, 2018 <br />• Samantha Berger, District Technician, Rice Creek Watershed District, January 15, 2019 <br />• Tyler McLeete, City Engineer, Stantec, January 16, 2019 <br />• Brian Lehinger, Assistant City Attorney, Kennedy & Graven, January 28, 2019 <br /> <br /> <br />Summary <br />Elin Marco Group is requesting approval of a Minor Subdivision, creating two lots (one new). <br /> <br />A Public Hearing is not required for Minor Subdivisions. A notice of the Planning Commission <br />meeting was mailed to property owners within 350’ of the project. No neighbors attended, nor <br />has Staff received any inquiries about the project. <br /> <br /> <br />Planning Commission Recommendation <br />The Planning Commission reviewed the request on February 6, 2019, recommending approval <br />of the Minor Subdivision (Resolution 1093-19). <br /> <br />The Planning Commission discussed Park Dedication Fees, how they are calculated, and if the <br />Fee was too high. <br /> <br />Park Dedication Fees are based on 10% of the Estimated Market Value (EMV) of useable land <br />for newly created lots (e.g. Parcel B). The EMV is divided by the square footage of the property <br />as-is to establish a value per square foot. That amount is then multiplied by the size of the new <br />lot. In this case, the EMV is $2.87 per square foot. By comparison, neighboring properties are <br />valued at $3.82 per square foot (north), $3.24 (east), $2.63 (south), and $1.64 (west). The <br />vacant ½ acre lot at “Anna’s Place” (Abiding Savior) is valued at $3.96 per sq ft. <br /> <br />The Applicant questioned if land to be dedicated as right-of-way should be used in calculating <br />the value per square foot. Staff included the ROW in calculating the $2.87 per square foot <br />EMV. To do differently, Staff would need to know the formula the County Assessor used to <br />establish the EMV (e.g. the reasoning why one lot is valued at $1.64 vs. $3.96 per square foot). <br /> <br /> <br />Staff Recommendation <br />Staff recommends approval of the Minor Subdivision. <br /> <br /> <br />The City Council is requested to consider the following options: <br /> <br /> <br />1. Resolution 9080, approving the Minor Subdivision. <br /> <br />2. The City Council may choose to deny approval of the Minor Subdivision. If the Council <br />chooses this option, Staff would need to be directed to draft a resolution of denial with <br />findings of fact appropriate to support the denial. <br />
