ORDINANCE NO. 805 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />AN ORDINANCE AUTHORIZING DISPOSAL BY SALE OF <br />REAL PROPERTY OWNED BY CITY <br />THE CITY OF MOUNDS VIEW ORDAINS: <br />SECTION 1. Appendix D of the Mounds View Municipal Code entitled "'Special Ordinances" <br />is hereby amended to include reference to the following Ordinance No. 805. <br />Subdivision 1. The City of Mounds View owns a parcel of land in Ramsey County, <br />Minnesota, the legal description of the property (hereinafter referred to as "the Property") <br />being as follows: <br />The South 32.5 feet of Lots 3 and 4, Block 1, Flink Addition, together with that <br />part of the vacated portion of Sunnyside Drive as described in Resolution <br />No. 490, dated June 22, 1970, filed of record as Documenf No. 1843534 and <br />the Notice of Completion of Vacation dated June 29, 1970, filed Book 2378, <br />page 223. <br />Subdivision 2. The City passed Resolution No. 490 in 1970 ("Resolution") that <br />purported to vacate the Property. The Resolution has been deemed to be inadequate or <br />inappropriate to convey said Property to subsequent landowners by Ramsey County based <br />upon Ramsey County's review of the plat of Abiding Savior Addition. In order to correct a title <br />defect as to the conveyance of the Property, the City desires to properly convey the Property <br />to Abiding Savior Lutheran Church, fka Spring Lake Park Lutheran Church to allow platting <br />thereof. The City Council has determined that conveyance of the Property will further the <br />public interest. <br />Subdivision 3. The City Council finds that the requirements of Minnesota Statutes <br />Section 462.356, Subdivision 2 are hereby deemed satisfied based upon the previous <br />attempted vacation by the City of the Property that is the subject of this transaction and that the <br />proposed conveyance of the Property to Abiding Savior Lutheran Church, fka Spring Lake Park <br />Lutheran Church is consistent with the comprehensive municipal plan of the City, or <br />alternatively, the City dispenses with the requirements of Minnesota Statutes Section 462.356, <br />Subdivision 2 and finds in the City Council's judgment that the proposed conveyance of the <br />Property to Abiding Savior Lutheran Church, fka Spring Lake Park Lutheran Church has no <br />relation to the comprehensive municipal plan of the City. <br />Subdivision 4. As provided by Section 12.05 of the City Charter, the City Council <br />authorizes conveyance of the above-referenced Property by quit claim deed in substantially <br />the form as set forth in the attached Exhibit A which is incorporated herein by reference to <br />Abiding Savior Lutheran Church, fka Spring Lake Park Lutheran Church. No proceeds will <br />result from this conveyance. <br />
