Mounds View EDA November 26, 2018 <br />Regular Meeting Page 2 <br /> <br />6. EDA BUSINESS 1 <br /> 2 <br />A. Resolution 18-EDA-315 Preliminary Development Agreement Extension. 3 <br /> 4 <br />Business Development Coordinator Beeman requested the EDA consider approval of a 5 <br />Preliminary Development Agreement Extension. He reported staff has been working with INH 6 <br />since January of 2018. He explained staff was working exclusively with INH on the purchase of 7 <br />the land and recommended approval of the Preliminary Development Agreement Extension. It 8 <br />was noted the extension would run through May 1, 2019. 9 <br /> 10 <br />Commissioner Gunn questioned why the agreement was not for a full year. Business 11 <br />Development Coordinator Beeman stated the proposed extension would give the developer 12 <br />enough time to negotiate the land price and draft a Preliminary Development Agreement. City 13 <br />Attorney Riggs reported the current preliminary development agreement would expire on January 14 <br />8, 2019. He anticipated that all terms could be completed by January 8th and explained this could 15 <br />be made a condition for approval. He recommended this condition be added to the fourth 16 <br />Whereas statement within the Resolution. 17 <br /> 18 <br />Commissioner Bergeron thanked City Attorney Riggs and Business Development Coordinator 19 <br />Beeman for their work on this item. 20 <br /> 21 <br />AMENDMENT MOTION/SECOND: Bergeron/Meehlhause. To Amend Resolution 18-EDA-22 <br />315 adding the following language to the fourth Whereas statement: Subject to a condition that 23 <br />the Developer and EDA shall finalize the negotiation of all terms necessary and related to the 24 <br />development of a Purchase Agreement and Development Agreement for the proposed 25 <br />development by January 8, 2019 with such condition being reviewed by the EDA at their meeting 26 <br />on December 10, 2018. 27 <br /> 28 <br />Commissioner Meehlhause stated he supported the additional language as proposed by the City 29 <br />Attorney. 30 <br /> 31 <br />Commissioner Bergeron explained he proposed this amendment in order to smooth things out in 32 <br />the negotiation process. 33 <br /> 34 <br />President Mueller thanked Commissioner Bergeron for making this suggestion. 35 <br /> 36 <br /> Ayes – 5 Nays – 0 Motion carried. 37 <br /> 38 <br />MOTION/SECOND: Gunn/Bergeron. To Waive the Reading and Adopt Amended Resolution 39 <br />18-EDA-315 Preliminary Development Agreement Extension. 40 <br /> 41 <br />President Mueller thanked staff and the EDA for all of their efforts on this item. 42
