The tire store has posted hours, <br />Monday thru Saturday 9:00 AM – 3:00 PM and has one employee. <br /> <br />Since the property is not used for Minor Auto Repair (e.g. installing tires), revoking the CUP has <br />no effect on the current use as a tire store. If revoked, and the current or future owner wishes to <br />conduct Minor Auto Repair, a new CUP can be applied for. <br /> <br /> <br />Strategic Plan Strategy/Goal: <br />Continue enforcement & responsiveness to drug problem, traffic, code violations, & petty crimes <br />& support 2nd K-9 unit. <br /> <br /> <br />Financial Impact: <br />Enforcement on this property has consumed a significant amount of Staff time and legal costs. <br /> <br /> <br />Summary: <br />In 2012, Tires N’More received a Conditional Use Permit for Tire and Minor Auto Repair. Until <br />recently, the property had significant violations of the Fire Code and Zoning Code. CUP’s may <br />be revoked by the City Council, with Findings. In this case, Findings include the owner’s failure <br />to operate the business such that it (Tire and Minor Auto Repair) provide a service and benefit <br />to the community. <br /> <br />Staff’s intent of the Council in considering revocation of the CUP is to establish a person <br />responsible for managing the property, and for that person to hear from the Planning <br />Commission and the City Council of their concerns. The intent is not to force Tires N’More out <br />of business, but for it to become a viable business serving the community. <br /> <br /> <br />Planning Commission Recommendation <br />At the April 17, 2019 Planning Commission meeting, the Commission recommended approval of <br />the Revocation of the CUP (Resolution 1096-19). Commissioners had concerns about the code <br />violations, the inability of the owners to open a retail store at this location, and the fact that the <br />CUP was not in use. <br /> <br /> <br />Staff Recommendation: <br />Staff recommends that the CUP be voluntarily revoked with the owner’s consent, or that the <br />CUP be revoked with Findings. <br /> <br />The Council is requested to conduct a Public Hearing, and consider the following options: <br /> <br />1. Request that the property owner, C & N Group, LLC (Naoufel Soussi, registered <br />Manager), consent to the revocation of the CUP. If this action is taken, a Resolution will <br />be prepared for Council action at a later date. It is Staff’s understanding that Naoufel <br />Soussi does not reside in the U.S. <br /> <br /> <br /> <br />
