Resolution 9133 <br />Page 3 of 3 <br />2. The Developer shall comply with any requirements of a Plat Opinion, to be issued by the City <br />Attorney. <br />The Developer shall pay a Park Dedication Fee of $110,000, equal to 10% of the land value (e.g. <br />10% of the agreed purchase price between the Mounds View EDA and INH Property <br />Management, excluding allowances). This fee shall be paid prior to the City signing the Final <br />Plat Mylar's. <br />4. The Developer shall construct all improvements shown on the Preliminary Plat (dated May 29, <br />2019), and Grading & Drainage Plan (undated, but received May 30, 2019) including, but not <br />limited to: <br />A. Greenfield Ave. hammerhead dead-end. <br />B. Removal of existing driveway access on Mounds View Blvd, restoration of landscaping <br />and trail, and restriping of shoulder. <br />C. All sidewalks and trails, whether within public right-of-way, or on private property. <br />D. All Stormwater infiltration basins, and related drainage infrastructure. Basins and <br />infrastructure shall be privately maintained. <br />E. All utilities shall be located, or relocated underground. <br />Minor variations from these plans may be administratively approved during the review process of <br />building permits and construction plans. <br />5. Approval of the Grading & Drainage Plan is subject to an approved permit issued by the Rice <br />Creek Watershed District (RCWD). A permit shall be approved or conditionally approved, prior <br />City approval of the Final Plat. <br />6. The Developer shall prepare and submit a Final Plat to the City for its review, and approval by <br />the City Council. <br />7. The City intends to Vacate any applicable public easement, prior to approval of the Final Plat. <br />8. Recording of the Final Plat shall occur after conveyance of the land from the EDA to the <br />Developer. All applicable easements shall be recorded concurrent with the Final Plat. <br />9. The Developer shall reimburse the City for all plan review expenses in excess of the Plat <br />Application Fee, including, but not limited to; City Engineer review, City Attorney review. <br />Adopted this 8t1i day of July, 2019. <br />Carol A.
