of Mounds View Staff R <br />Item No: 07A <br />Meeting Date: Sep 9, 2019 <br />Type of Business: Special Order of Business <br />City Administrator Review: <br />To: Honorable Mayor and City Council <br />From: Jon Sevald, Community Development Director <br />Item Title/Subject: Charitable Gambling - Discussion <br />Discussion: <br />A Bingo Hall would like to relocate from Arden Hills to Mounds View into one of the vacant <br />commercial properties (there are several). The Zoning Code does not specifically address <br />chartable gambling, and therefore is prohibited as a standalone use.' <br />The Zoning Code does allow uses that are similar to those specific uses listed in the Code if the <br />Council interprets it as such.' One option is "Commercial Recreational Uses", which is a <br />Permitted Use in the B-3 and B-4 districts (e.g. Tires N'More, EI Loro, Snyder's). Commercial <br />Recreational Uses is not specifically defined in the Zoning Code. <br />Chapter 500 (Business License Regulations) allows charitable gambling in businesses that have <br />an on -sale liquor license (e.g. a restaurant or bar with pull -tabs ).3 <br />Recommendation: <br />Staff is requesting direction from the Council if to put this topic on a future Council Work <br />Session. If yes, Staff will conduct more in-depth research of how to make this work. If no, then <br />the Bingo Hall will need to look elsewhere. <br />Staff's preference is to amend Chapter 500 only if the Bingo Hall applies for an amendment. <br />Respectfully submitted, <br />�eQ0 <br />Jon Sevald, AICP <br />Community Development Director <br />' City Code, Section 1101.08 (Uses not provided for within zoning districts): "Whenever in any zoning district a use <br />is neither specifically permitted nor denied, the use shall be considered prohibited.".... <br />City Code, Section 1112.02 (Permitted Uses in B-1 district); "The City will allow uses similar to those listed <br />above in this Section if the proposed use would not create a nuisance and if the use would not be noxious or <br />hazardous. The City Council shall review uses that are not clearly similar to those listed in this Section for a <br />determination of compatibility. " <br />s City Code, Section 518.06, Subd 8; "The Council shall deny an application for issuance or renewal of a premises <br />permit for any of the following reasons: " (c) "Lawful gambling would be conducted at premises other than those <br />for which an onsale liquor license has been issued.
