Resolution 7319 <br />Page 3 <br />2) Any modification of the surface of the swale that <br />adversely affects the infiltration functionality will not <br />be allowed. <br />3) Any modification of the swale size, shape, depth, or <br />other parameters requires advance approval of the <br />city. <br />4) Upon request, the City will provide the Property <br />Owner with a list of technical resources for plantings. <br />b. The Property Owner will be solely responsible for initial and <br />ongoing costs of Optional Improvements. <br />c. The Property Owner will be solely responsible for the <br />installation of Optional Improvements. <br />d. The Property Owner will be solely responsible for all ongoing <br />maintenance of Optional Improvements. <br />e. Optional Improvements may be performed at any time <br />following the construction of the swale. <br />4. The City Responsibilities and Rights regarding Optional <br />Improvements within Infiltration Features included with the Street <br />and Utility Improvement Program shall be: <br />a. Upon request, the City shall provide to the Property Owner <br />any information it may have regarding possible financial <br />assistance programs for the Optional Improvements. <br />b. The City shall have the authority to prevent Optional <br />Improvements from becoming unsightly or causing any other <br />type of nuisance to the public. <br />c. The City shall have the right to remove any Optional <br />Improvements as necessary for activities to maintain the <br />storm water management functionality of the swale. <br />1) Any areas disturbed by the City in the course of <br />maintenance activities will be restored by the City with <br />the Standard turf as described in Part 1 of this <br />Resolution. <br />2) Any reinstallation or replacement of Optional <br />Improvements in areas affected by City maintenance <br />activities shall be the sole responsibility of the <br />Property Owner, in accordance with Part 3 of this <br />Resolution. <br />
