City of Mounds View Staff Report <br />Item No: 08C <br />Meeting Date: September 23, 2019 <br />Type of Business: Council Business <br />City Administrator Review: <br />To: Honorable Mayor and City Council <br />From: Nyle Zikmund, City Administrator <br />Item Title/Subject: First Reading, and Introduction of Ordinance 964, Amending <br />City Code, Section 503.04 related to 3.2% Malt Liquor License <br />Regulations <br />Introduction: <br />The City has received an inquiry from a business owner who would like to apply for an <br />off -sale liquor license to sell 3.2% beer, but the business is located less than 500' from <br />a church. City Code requires that off -sale liquor establishments be more than 500' from <br />any public school or church.' <br />Discussion: <br />The City Attorney has researched this topic, and found no legal reason for the 500' <br />setback to be applicable to Mounds View. The proposed amendment would not reduce <br />the 500' setback for intoxicating liquor (e.g. wine and hard alcohol). <br />Strategic Plan Strategy/Goal: <br />N/A <br />Financial Impact: <br />N/A <br />Recommendation: <br />Staff recommends the Council conduct a First Reading and Introduction of Ordinance <br />964.
