ORDINANCE 966 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />AN ORDINANCE VACATING <br />A PORTION OF GREENFIELD <br />AVENUE IN THE CITY OF <br />MOUNDS VIEW <br />WHEREAS, INH Property <br />Management Inc (Developer), <br />representing the property <br />owner; Mounds View Economic <br />Development Authority (EDA), is <br />requesting approval of the Final Plat <br />of Crossroad Pointe. The project <br />is divided by Greenfield Avenue as <br />described on Exhibit A, and includes <br />easements for utilities, driveways <br />and parking, and is no longer needed <br />for a public purpose; <br />WHEREAS, any person, corporation <br />or City owning or controlling utility <br />easements contained upon the <br />property vacated, reserves the right <br />to continue maintaining the same or <br />to enter upon such way or portion <br />thereof vacated to maintain, repair, <br />replace, remove or otherwise attend <br />thereto; and, <br />WHEREAS, it is intended that any <br />person, corporation or city owning <br />or controlling utility easements <br />contained upon the property <br />vacated shall realign the same with <br />the realigned right-of-way to be <br />dedicated to the public pursuant to <br />the plat of Crossroad Pointe; and, <br />NOW, THEREFORE, THE CITY OF <br />MOUNDS VIEW ORDAINS: <br />SECTION 1. The City of Mounds <br />View Municipal Code Appendix <br />D is hereby amended to include <br />reference to the following Ordinance <br />966: <br />Subdivision 1. The City <br />has made a determination that the <br />land constituting the public roadway <br />of the traveled portion of Greenfield <br />Avenue as described below is no <br />longer needed for a public purpose, <br />and as such, it is in the public <br />interest to vacate such portion of <br />the previously traveled Greenfield <br />Avenue described as follows: <br />See Exhibit A <br />Subdivision 2. <br />The public utilities or facilities located <br />in the portion of the Greenfield <br />Avenue roadway easement area <br />to be vacated described in Exhibit <br />A of this ordinance are intended <br />to be relocated to the right of way <br />or easements to be dedicated <br />to the public pursuant to the <br />plat of Crossroad Pointe. The <br />proposed vacation of the portion <br />of the Greenfield Avenue roadway <br />therefore will not adversely affect <br />the ability of the City or other utility <br />to maintain, repair, or replace public <br />utilities. <br />Subdivision 3. <br />The City Council finds that there is no <br />longer a public need for that portion <br />of the Greenfield Avenue roadway to <br />be vacated, as describe in Exhibit A <br />of this ordinance. <br />Subdivision 4. The portion of the <br />roadway, as described in Exhibit A of <br />this ordinance is hereby vacated. <br />SECTION 2. In <br />accordance with Section 3.07 of the <br />City Charter, City staff shall have <br />the following summary printed in the <br />official City newspaper in lieu of the <br />complete ordinance: <br />On September 23, 2019, the City <br />Council adopted Ordinance 966, <br />vacating portions of Greenfield <br />Avenue, generally south of County <br />Road H2, and north of 5264 <br />Greenfield Avenue (Brentwood <br />Terrace apartments), within the <br />development known as "Crossroad <br />Pointe' <br />A printed copy of the ordinance <br />is available for inspection during <br />regular business hours at Mounds <br />View City Hall and is available on line <br />at the City's web site located at www. <br />moundsviewmn.org. <br />SECTION 3. This ordinance <br />shall take effect and be in force 30 <br />days from and after its passage <br />and publication, in accordance siith <br />Section 3.09 of the City Charter. <br />Introduction and First Reading by <br />the Mounds View City Council on <br />September 9, 2019. <br />Second Reading and Adoption by <br />the Mounds View City Council on <br />September 23, 2019 <br />Carol A.
