Ordinance 804 <br />Page 14 <br />1303.10: Penalties <br />Subd. 1. SUSPENSION OR REVOCATION: The City may, in writing, suspend or <br />revoke a permit issued under the provisions of this Chapter whenever the <br />permit is issued in error or on the basis of incorrect information supplied, <br />or is found to be in violation of any ordinance or regulation or any of the <br />provisions of this Chapter. <br />Subd. 2. CITY REMEDY: If compliance with the approved land disturbance plan <br />is not accomplished within the allowable time period described in the letter <br />of warning, the City may bring the project into compliance by use of the <br />financial security based on a time period written in the notice of violation. <br />Subd. 3. STOP WORK ORDER: If corrective actions identified in the letter of <br />warning are not completed by the time period set forth by the City in the <br />letter, the Public Works Director or his or her designee may issue an order <br />for the City to stop all inspections required for land use or building permit <br />approvals for the site until all corrective actions identified in the letter of <br />warning are completed. The applicant shall notify the Public Works <br />Director or his or her designee upon completion of the corrective action. <br />Once the Public Works Director has verified that corrective action has <br />been taken, he or she shall inform the applicant and the City shall resume <br />inspections on the site no later than the following business day. <br />Subd. 4. FINES: Any person that violates any provision of this Chapter may be <br />given an administrative citation and be required to pay an administrative <br />fine pursuant to the administrative offense provision of the City Code. <br />Subd. 5. MISDEMEANOR: Any person convicted of violating any provision of <br />this Chapter shall be guilty of a misdemeanor and shall be subject to a fine <br />or imprisonment as specified by state statute. Such penalty may be <br />imposed in addition to an action against the financial security, a stop work <br />order or suspension or revocation of the permit by the City. <br />SECTION 2. This ordinance shall take effect and be in force 30 days from and <br />after its passage and publication, in accordance with Section 3.09 of the City <br />Charter. <br />Introduction and First Reading by the Mounds View City Council on October 27, <br />2008 <br />Second Reading and Adoption by the Mounds View City Council on November <br />10, 2008. <br />
