CHAPTER 4 1 <br /> 2 <br />NOMINATION AND ELECTIONS 3 <br /> 4 <br />SECTION: 5 <br />4.01 The Regular Municipal Election 6 <br />4.02 Filing for Office 7 <br />4.03 Procedure at Elections 8 <br />4.04 Special and Advisory Elections Except for Elected Office 9 <br />4.05 Vacancy of Municipal Elected Office 10 <br />4.06 Insufficient Number of Candidates 11 <br /> 12 <br />Section 4.01. Municipal Election 13 <br /> 14 <br /> Subdivision 1. Definitions. 15 <br /> Municipal General Election: A municipal general election shall be held on the first 16 <br />Tuesday after the first-Monday in November of each even numbered year commencing in 1980 17 <br />at such places as the City Council shall designate. 18 <br /> Municipal Special Election: For the purpose of filling a Council vacancy or to address a 19 <br />referendum issue a municipal special election shall be held on the second Tuesday of February, 20 <br />April, May or August, or the first Tuesday after the first Monday in November per MN Statues 21 <br />205.10 Municipal Special Elections Subd 3a, 3b, 5, 6, as amended. MN Statue 205.10 22 <br />Subdivision 1 applies only in the manner that this Charter specifies, per MN Statute 205.02 23 <br />Subd2, as such provisions specified are not in conflict with this Charter for Council authority to 24 <br />call for special elections and voter petition qualifications. 25 <br /> 26 <br /> Subdivision 2. Notice of Election. The City Administrator shall post a notice in at least 27 <br />one public place in each election precinct, and by publishing a notice at least once in the official 28 <br />newspaper of the City stating the time and the places of holding such election and of the officers 29 <br />or issue to be elected, per MN Statute 205.13 Candidates, Filing, as amended . Failure to give 30 <br />such notice shall not invalidate such election. The City Administrator shall post the election date 31 <br />and place on the City Hall electronic board, and on Long Lake Road, Silver Lake Road, County 32 <br />“I” and County “10” where “Welcome to the City of Mounds View” are posted, for both 33 <br />municipal general and special election dates for the City. 34 <br /> 35 <br /> Subdivision 3: Assumption of Duties. Elected and qualified officers provided for by this 36 <br />Charter shall assume the duties of office to which they were elected on the first Monday of 37 <br />January following such election, per MN Statute 205.07 City General Election, as amended. 38 <br /> 39 <br />Section 4.02. Filing for Office 40 <br /> 41 <br /> Subdivision 1. Procedure. Pursuant to Minnesota Statute 205.13, subd. 1a, as amended, 42 <br />an affidavit of candidacy for a city office must be filed within the time frame specified and in 43 <br />accordance with the Statute with the exception that the fee portion of the Statute shall be 44 <br />superseded by the following: Any resident of the City qualified under state law for elective office 45 <br />may, by filing an affidavit and by paying a filing fee of $20 or by filing a petition in compliance 46
