8.02 Definitions – (Draft Version dated May 11, 2012) Application. For the purpose of this chapter the terms 1 <br />defined in this section shall have the meanings ascribed to them. 2 <br /> 3 <br />Public Improvement: Something done or added that increases value, brings into a more valuable or desirable 4 <br />condition, or betterment of property or right-of-way owned by the City. 5 <br /> 6 <br />Local Improvement: (MN Statute 429.021) A public improvement done by special assessment under the 7 <br />authority of MN Statute 429.021, as amended. 8 <br /> 9 <br />Local Character: Provide a high priority to maintain the predominate appearance and use of an existing area(s). 10 <br /> (or) Provide a high priority to maintaining all existing area’s predominate appearance and use. 11 <br /> 12 <br />Special Assessment: Any assessment made to an individual property or collection of properties which abut or 13 <br />is/are identified as being improved by or maintained by as a result of the local or public improvement being 14 <br />completed. 15 <br /> 16 <br />Assessment Procedure: as described in MN Statute 429.061 shall apply to this chapter 17 <br /> 18 <br />City Services: Include those services sited under MN Statutes Chapter 471 (Municipal Powers), as amended, 19 <br />that residents of the municipality City expect the city government to provide in exchange for the taxes and fees 20 <br />citizens or residents pay. Basic city services may include, but are not limited to, sanitation (both sewer and 21 <br />refuse), water, streets, inspections, public safety (fire department, police, ambulance) snowplowing, and other 22 <br />health department issues and transportation. Services may be run directly by a department of the municipality 23 <br />City or be sub-contracted to a third party. 24 <br /> 25 <br />Assessment District: The collection of all properties specifically identified in the Notice of Hearing for a 26 <br />proposed Local or Public Improvement plan Plan published in the official newspaper; or and, upon Council 27 <br />approval of the PublicLocal Improvement Resolution, the collection of all properties specifically identified by 28 <br />County Property Record number in the Resolution and notice sent to the property owner of record prior to the 29 <br />Council action to approveal the Improvement Resolution. 30 <br /> 31 <br />Benefited Property: The property or properties which will be improved or maintained as a result of the 32 <br />improvement being completed. The benefit to the property shall be identified as a dollar or access or health 33 <br />value to property owner or City by the City when proposing the improvement. The identified benefit shall not 34 <br />require any type of certification or verification by third party. The identified benefit may be nullified as a result 35 <br />of a properly filed petition using the Petition Process by the properties for the proposed Assessment District, or 36 <br />individually modified by the Council as a result of an oral contest request of the property owner directly to the 37 <br />City Council at a City Council meeting. Nothing in this definition will preclude a property owner from their 38 <br />rights under MN Statute 429.081 to appeal an assessment to the District Court. 39 <br /> 40 <br />Administrative Offense: According to Chapter 702 of the City Code, an Administrative Offense is a 41 <br />violation of a section, subdivision, paragraph or provision of this Code when one performs an act prohibited, 42 <br />or fails to act when such failure is thereby prohibited and is subject to the penalty set forth in Section 104.01 43 <br />of this Code, and the schedule set forth hereafter. The City may issue an administrative offense citation to 44 <br />someone who fails to remove junk and debris from their yard, permits a junk vehicle to be parked upon the 45 <br />property, fails to obtain a building permit, fails to pay a false alarm charge, etc. 46 <br /> 47 <br />Service, (as used in current section 8.05): 48 <br /> 49 <br />Public Improvement Project: A project comprised of one or more public improvement segments that may 50 <br />span multiple years. 51 <br /> 52 <br />Requirements: 53
