provided for. The City may also obtain an administrative search warrant in order
<br />to enter the property to inspect any discharge into the sanitary sewer system and
<br />to determine compliance with this Code. Any owner of a property found to be
<br />discharging storm water into the City sewer sys tem, either directly or indirectly
<br />shall make the necessary changes and furnish proof of the changes to the City
<br />within sixty (60) days of the finding of noncompliance, unless such other time is
<br />agreed to by the City, in order to comply with this Code. (Added, Ord. 740,

<br />Subd. 4.Future Inspections: At any future time, if the City has reason to suspect that an
<br />illegal connection may exist in a premises, the owner, by written notice shall
<br />comply with the provisions of Chapter 907.06, Subdivision 3. (Added, Ord. 740,

<br />Subd. 5.Surcharge: A surcharge of seventy five dollars ($75.00) per quarter shall be
<br />imposed and added to every sewer billing mailed on and after January 1, 2005 to
<br />property owners that are not in compliance with this Section. The surcharge fee
<br />shall be set by City Council resolution. The surcharge shall be added for the
<br />entire quarter until the property is in compliance. (Added, Ord. 740, 6-28-04;

<br />Subd. 6.Penalties: Any violation of this Section is a misdemeanor and is subject to
<br />penalties provided for such violations under provision of Chapter 702 of

<br />SECTION 3.The City Council of the City of Mounds View hereby amends Title 900, Chapter
<br />912,Illicit Discharge and Connections to Storm Drainage System,Section 912.06, Subd. 2, of
<br />the Mounds View Municipal Code by adding the double-underlined material and deleting the
<br />stricken material as follows:
<br />912.06:DISCHARGE AND CONNECTION PROHIBITIONS:
<br />Subd.2.Exemptions to Discharge Prohibitions: The commencement, conduct, or
<br />continuance of any illegal discharge to the storm drainage system is prohibited except as
<br />described as follows:
<br />a.a.Discharges resulting from the following activities: water line flushing, sump pump
<br />discharge, landscape irrigation, diverted stream flows, rising ground waters,
<br />uncontaminated ground water infiltration, uncontaminated pumped ground water,
<br />discharges from potable water sources, foundation drains, air conditioning condensation,
<br />irrigation water, springs, water from crawl space pumps, footing drains, lawn watering,
<br />individual residential car washing, flows from riparian habitats and wetlands,
<br />dechlorinated swimming pool discharges, and street wash water.
<br />b.Discharges or flow from fire fighting, and other discharges specified in writing by
<br />the City as being necessary to protect public health and safety.
