Subd. 5. Pet stores; provided, that: <br />a. Noise and odor are effectively confined to the premises in accordance with <br />Chapter 604 of this Municipal Code, Nuisances. <br />b. The boarding of animals is prohibited, except for the purposes of retail sales. <br />C. A mechanical ventilation or exhaust system shall be installed to control, capture and <br />remove emissions or odors generated by such use. Such systems shall be separate from the <br />other ventilation systems in the building. Such system shall be designed to prevent the <br />migration of emissions or odors to other parts of the building. Installation must comply <br />with the Minnesota State Building Code Mechanical Systems, Chapter 4-34-51346. <br />SECTION 8. The City Council of the City of Mounds View hereby amends Title 1100, Chapter <br />1123, Section 1123.03 of the Mounds View Municipal Code by deleting the stricken material and <br />adding the double -underlined material as follows: <br />1123.03: DISCONTINUANCE OF NONCONFORMING USE: Whenever a lawful <br />nonconforming use of a structure or land is discontinued for a period of six (6) montmore than <br />one year, any future use of said structure or lands shall be made to conform with the provisions of <br />this Title. <br />SECTION 9. The City Council of the City of Mounds View hereby amends Title 1100, Chapter <br />1123, Section 1123.07 of the Mounds View Municipal Code by deleting the st-r4ek€n material and <br />adding the double -underlined material as follows: <br />1123.07: DAMAGE AND DESTRUCTION: If, at any time, a nonconforming building, <br />structure or use shall be destroyed to the extent of more than fifty percent (50%) of its fair market <br />value, as indicated in the records of the county assessor at the time of damage and no building <br />permit has been applied for within 180 days of when the property is damaged any future use of <br />said structure or lands shall be made to conform with the provisions of this Title said N, lue to bo <br />detefmined_ by the Couneil, then, w th out ftirth --. aefien from the Couneii, the building and the land <br />enwhieh sueh btiildingwas located or maipAained shall, from and after- the date of said , <br />be subjeet to all the regulations speeified by the . - - lations for the dist-14a in whieh such <br />land and buildings are leeated.
