I~lcsoLUTloly 73gs <br />CITY OF MOUNDS VIEW <br />C~3UNTY C}F RAIVISEIj <br />STATE OF ?~IINPdESt~TA <br />RESOLUTION AUfiHORIZING ABATEMENT OF NliISANCE CODE <br />VIaLATIONS AT St)55-57 SUNYSIDE ROAD, IVIQUNDS VIEW, MINNESOTA, 55112. <br />WHEREAS, Steve Francis Oberstar Jr. is the ownex of property located at 5055-57 <br />Sunnyside Road, zoned R-2, Single & Two Family Residential,, legally described as follows: <br />TWELVE: OAKS 2ND AIDDITIOIV EX N 25 FT L47T 6 AND N 50 FT QF LOT 7 BLK 6 <br />FIN # 07-30-23-433-0075: <br />'WHEREAS, or, November 1~, 20418 staff inspected the property located at x055-5T <br />Sunnyside Rd in response to information received regarding exterior accutzlulations of garbage,.. <br />junk az-~d debris; and <br />WHEREAS, on November 19, 2008 a Summary Abatement Order was issued to Steve <br />Oberstar Jr. requiring corrective actions completed to bring 5055-57 Sunnyside Road into <br />compliance with Garbage and Rubbish Storage. and Removal requirements of the City Code by <br />November 27,..2008,; and <br />~,'VHEREAS, on December 1, 2008 staff performed a ft~llow up inspzction ;of 503.5-57 <br />Sunnyside Rd and found that the property was not in compliance, and <br />WHEREAS, on I?ecerrtber 1, 2008 an ,4drninistrative Citation.. was issued to Steve <br />Oberstar Jr. for violation of Section 607.03 Subd. lh of the City Code; anti <br />WIII?,REAS, in a letter dated-December 4, 2008, staff notified. Steve Oberstar Jr. of its <br />ntentto-appear before the Mounds View City Council. an December 22, 2008 to request <br />authorization to abate violations cited in the Summary Abatement Order; and. <br />1r`~I-IEREAS Steve Oberstar Jr, is responsible for maintaining Nuisance Code v%olations <br />orr the exterior of the above-said property that include, but are not limited tQ: <br />1. $ags of trash. <br />2. 2 automotive batteries, <br />3. Brokenlunusable basketball hoop. <br />4. Household furnishings and appliances <br />WHEREAS,: the City Council finds that the nuisance. code violations at 5055-57 <br />Sunnyside 'Road constitute a Public Nuisance under Section 607.03 Subd. "1 h and .507.03 Subd. <br />3c and the City may abate and assess the costs.. of said abatement against the property pursuant: to <br />Minn, Stat. 429.101; and <br />WHEREAS, the City has complied with the notification requirement for nuisance <br />abatement as stated in 607.09, Subd. Sb. of the Mounds View: Municipal Code; and <br />
