RESOLUTION 7389` CITY OF MOUNDS VIEW COUIY'TY OF RAMSEY STATE OF MINNF,S()TA RESOLUTION AUTHORIZING .ABATEMENT OF NTISANCE CODE VIOLATIONS AT 2070 TERRACE DRIVE, MOUNDS VIEW, MINNESOTA, 55112. W1~EREAS, Mary G. Higgins is the owner of property located at 2070 Terrace Dave, zoned R-l, Single >~ amity Residential, legally described as follows: FINL'tVOtJD TERRACE SUB.T fi0 STH 8/63 LQT 1 BLK 3 PIN# OS-30-23-~4-0058 WHEREAS,. on November 21, 2008, staff inspected the property located at 2070 Ten•ace Drive ix response to information received regarding exterior accumulations of junk and debris; and. WIIEI~EAS, a notice of violation was issucd to Mary G. Ilggins dated November 2l; 2fl08 and. requested corrective actions completed to bring the property into compliance with.. Section b07.03 Subd. `3c of the Nuisance Code by December 1,.200& :and WHEREAS, on December 4, 2008 staff performed a follow up inspection of 2070 Terrace Drive. and found that corrective actians had not been completed; and WHEREAS, iii a letter dated December 4, 200$, staff'notifi~d Mary'G. Hi~~;ins of its intent to appear before the Mounds View City Council on December 22, 20b8 to request authorization to abate violations cited in the Notice of Violation dated November 21, 2008; and WHERl~AS Mary Cx. Higgins is responsible for maintaining Nuisance Gode violations on the exterior of the above-said property that include, but are not. limited to: l . Mattress next to garage. 2. Accumulations of rusting metal, junk and. debris.. 3. Inoperahlefunusable household furnishings.. WHEREAS, the City Council finds that the nuisance code violations at 2070 Terrace Drive constitute a Public Nuisance under Section 607.03 Subd. 3c and the City may abate and assess the costs of said abatement against the property pursuant to Nlinn, Stat. 429,1031:; and WHEREAS, the Gity has catnplied with the notification requirement for nuisance abatement as stated in 607.09, Subd. Sb. of the iVlounds View Municipal Code; and WHEREAS, Mary° G. Higgins, property ocviler of 2070 Terrace Drive, will be personally liable to the City for the costs of such abatement, including administrative costs pursuant to Section:607.09 Subd. 7 of the Mounds View Municipal Code; and...
