• <br />C� <br />• <br />RESOLUTION NO. 4663 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION DIRECTING THE CITY CLERK NOT TO FILE <br />CHARTER AMENDMENT CONCERNING TERM LIMITS <br />WHEREAS, at the November 8, 1994 election, a ballot <br />proposition pertaining to limiting the number of terms that the <br />Mayor and City Councilmembers may hold was adopted by the voters; <br />and <br />WHEREAS, the Minnesota Attorney General has concluded.that a <br />term limits provision such as the one adopted at the November 8, <br />1994 election violates the Minnesota Constitution; and <br />WHEREAS, a case involving the City of Minneapolis is <br />currently pending before the Minnesota Supreme Court that will <br />address the constitutionality of term limits; and <br />WHEREAS, Minnesota Statutes, Section 410.11 requires the <br />City Clerk to file a copy of the charter amendment with the <br />Secretary of State and County Recorder; and <br />WHEREAS, the City Council must provide for the orderly <br />administration of justice and insure that the Mounds View City <br />Charter does not contain any unconstitutional provisions. <br />NOW, THEREFORE, BE IT RESOLVED by the Mounds View City <br />Council that the City Clerk is directed not to file the charter <br />amendment that was passed on November 8, 1994 until the Supreme <br />Court has issued a final ruling as to the constitutionality of <br />term limits in the case that is presently pending before it <br />involving the City of Minneapolis. <br />ATTEST: <br />(SEAL) <br />Adopted this 14th day of November, 1994. <br />erryxinke, Mayor <br />Sam4ntha drduno, City Administrator <br />
