hearing on the improvement. However, no contract shall be let in the event that <br />the current proposed contract exceeds the estimated cost by more than ten percent. <br />Subd. 4. When a proposed improvement is disallowed under the foregoing sub- <br />divisions, the council shall not vote on the same improvement within a period of <br />one year after the public hearing on said improvement. <br />Sec. 8.05. Assessments for Services. The council may provide by ordinance that <br />the cost of city services to streets, sidewalks, or other public or private property <br />may be assessed against property benefited and may be collected in the same manner <br />as special assessments. Such costs shall not be deemed to be "special assessments" <br />for the purposes set forth in section 8.03 of this chapter. <br />CHAPTER 9 <br />EMINENT DOMAIN <br />Sec. 9.01. Acquisition of Property. The city may acquire by purchase, gift, con- <br />demnation, or otherwise, any real property, either within or without its boundaries, <br />that may be needed by the city for any public purpose. In acquiring property by <br />exercising the power of eminent domain, the city shall proceed according to Minnesota <br />law, Chapter 117, or other applicable laws. <br />CHAPTER 10 <br />FRANCHISES <br />Sec. 10.01. Except as otherwise provided by state law, no person, firm or corpor- <br />ation shall place or maintain any permanent or semi-permanent fixtures in, over, upon <br />or under any street or public place for the purpose of operating a public utility, or <br />for any other purpose, without a franchise therefor from the city.
