The Mounds View Vision <br />A Thriving Desirable Community <br /> <br />Item No: 08B <br />Meeting Date January 13, 2020 <br />Type of Business: Council Business <br />City Administrator Review: _____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Nyle Zikmund, City Administrator <br />Item Title/Subject: Second Reading Ordinance 970 Title 1100, various Chapters, <br />Zoning Code <br /> <br />Introduction: <br />This is a continuation of the systematic update of all codes with Chapters 100 through <br />1000 completed and upon final adoption of 1100, 1200 – 1500 will remain. <br /> <br />The Ordinance has been published on our web page since November 19, 2019. This <br />ordinance requires review by the Planning and Zoning Commission and was heard at <br />their December meeting. A public hearing is also required prior to final adoption with 10 <br />days prior notice. The first reading occurred last November. <br /> <br />Discussion: <br />Detailed below are the substantive changes. <br />1. Clarification regarding the front lot and/or lot width definitions in Chapters 1102 <br />and 1103. We changed the party who decides front lot in the case of equal street <br />frontage on corner lots from the owner to the Zoning Administrator. <br /> <br />2. Section 1104.02 provides that the minimum lot size for two-family lots in R-2 was <br />6,250 square feet. We fixed that by removing some of the language in the chart. <br />In the case of a zero lot line twin home, the two homes will technically be on their <br />own lot. <br /> <br /> <br />3. No changes were made to Chapter 1124 (regarding Wireless <br />Telecommunications Facilities), but it appears those are necessary due to the <br />recent legislative changes for small cell wireless facilities. The city amended its <br />ROW ordinance to reflect these changes, but it appears there are revisions <br />necessary in the zoning code. The City Attorney and I suggest that be reviewed <br />separately because it will require additional policy-related input and a more <br />thorough examination of Chapter 1124’s interplay with the recent small cell/ROW <br />changes. If for some reason there are applications or requests made regarding <br />wireless facilities in the interim, we will collectively determine how best to <br />proceed with them on a case-by-case basis. <br /> <br />4. Nonconforming uses are governed by state law and revisions to Chapter 1123 <br />were made to make things consistent with statutory requirements. Cities are <br />generally preempted from coming up with different regulations than those <br />provided in Minn. Stat. Ch. 462. <br /> <br /> <br /> <br />
