1 <br />628764v3MU210-262 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />DEVELOPMENT AGREEMENT <br />LONG LAKE WOODS SECOND ADDITION <br /> <br /> THIS DEVELOPMENT AGREEMENT (the “Agreement”) is made this ____ day of <br />_______________, 2020, by and between the City of Mounds View, a Minnesota municipal <br />corporation, (the “City”), and the following individuals and entities which shall be referred to <br />collectively herein as the “Developer”: NuWay Development, Inc., a Minnesota business corporation, <br />Daniel Behnken and Gwen Behnken, a married couple, Margaret Krig, a single person, Hans <br />Melgaard and Ilona Melgaard, as Trustees of the Hans Leland and Ilona L. Melgaard Trust dated <br />October 31, 2018, Carlos Nazareth and Lina Nazareth, a married couple, Hazel Jennings, a single <br />person, and Michael Lauterbach [need marital status], Patrick Lauterbach [need marital status], and <br />Steven Lauterbach [need marital status]. <br /> <br />Recitals <br /> <br /> A. The individuals and entities that make up the Developer are fee owners of certain real <br />estate located in the City of Mounds View, Ramsey County, Minnesota, legally described as <br /> <br />(See Exhibit A) <br /> <br />(the “Property”). <br /> <br /> B. The Developer desires to plat and develop a portion of the Property (the <br />“Subdivision Property”) as 12 single-family residential lots (the “Subdivision”), subject to the <br />conditions and requirements contained in the Mounds View City Code, this Agreement and state <br />statutes. A depiction of the proposed Subdivision is attached hereto as Exhibit B. <br /> <br /> C. The Subdivision will require certain public improvements, including a northbound <br />extension of Greenwood Drive and the extension of public sewer and water to provide both <br />adequate access and public utilities to the Subdivision (collectively, the “Public Improvements”). <br /> <br /> D. The City is willing to construct and install the Public Improvements as a public <br />project in accordance with all state and local laws and this Agreement, with the understanding that
