The SWM charge shall be adjusted annually on July 1 according to the change in the <br />Engineering News Record Construction Cost Index for the Minneapolis-St. Paul area. <br />Subd. 6. Use of Fund: Any SWM charge payments deposited in the Fund shall be used only for <br />expenses incurred in the design, construction, preservation or improvement of City storm <br />water management systems. These expenses shall include, but shall not be limited to, <br />acquisition of land, woodlands and easements, construction of water quality control <br />improvements, preservation of woodlands and debt retirement in connection with storm <br />water management system improvements. <br />Subd. 7. Transfer of Funds: Any SWM charge payments deposited in the Fund shall not be <br />transferred out of the Fund, except for the purposes enumerated in subdivision 6 above. <br />(Ord. 504, 4-27-92) <br />203.08:SPECIAL PROJECTS FUND: <br />Subd. 1. Definitions: When used in this Section, the following words and phrases shall have the <br />meanings ascribed to them in this subdivision: <br />a. CAPITAL IMPROVEMENT PROJECTS: Projects which are intended to acquire, <br />construct, permanently modify or purchase assets of a long term character which are <br />intended to continue to be held or used, such as land, buildings and machinery. <br />b. EMERGENCY: An occurrence where the public health, safety and welfare is <br />jeopardized, where immediate action is necessary and must be declared by a four-fifths (4/5) <br />vote of the entire Council. <br />c. ENTERPRISE FUND: A fund established to finance and account for the acquisition, <br />operation and maintenance of governmental facilities which are entirely or predominantly <br />self-supporting by user charges. Examples of enterprise funds are those for water, sewer, gas <br />and electric utilities, swimming pools, airports, parking garages and transmit systems.
