4 <br />4. Has caused a work-related accident or was operating or helping <br />to operate machinery, equipment, or vehicles involved in a work- <br />related accident. <br /> <br />b. Treatment Program Testing: When the City has referred an <br />employee for chemical dependency treatment or evaluation or when <br />the employee is participating in a chemical dependency treatment <br />program under an employee benefit plan, the employee may be <br />tested, without prior notice, during the evaluation or treatment period <br />and for a period of up two (2) years following the completion of any <br />prescribed chemical dependency treatment program. <br /> <br />c. Routine Physical Examination Testing: The City may require drug <br />and alcohol testing as part of a routine physical examination. An <br />employee will receive at least two (2) weeks’ written notice that a <br />drug and alcohol test may be requested or required as part of the <br />physical examination, which drug and alcohol test will occur no more <br />than once annually. <br /> <br />d. Random Testing: The City may require drug and alcohol testing on <br />a random selection basis for employees who are employed in safety- <br />sensitive positions. “Safety-sensitive positions” are jobs in which an <br />impairment caused by drug or alcohol usage would threaten the <br />health or safety or any person. <br /> <br />5. Job Applicant Testing: Job applicants who have received a job offer <br />conditioned upon the applicant submitting to and passing a drug and alcohol <br />test will be required to undergo drug and alcohol testing. The conditional <br />job offer will be revoked and the applicant will not be hired if one or more of <br />the following occur: <br /> <br />a. The applicant leaves the testing clinic before giving a suitable <br />specimen or the applicant refuses to take the test. <br /> <br />b. The applicant tests positive (fails) the test, and the result has been <br />verified by a confirmatory test. <br /> <br />c. The applicant tampers, adulterates, or otherwise interferes with a <br />drug and alcohol test <br /> <br />d. The applicant has had two (2) diluted or untestable specimens. <br /> <br />6. Testing as a Result of a Customer Requirement: Certain customers of the <br />City of Mounds View may require that City’s employees, prior to working on <br />an assignment for them, be subject to drug and alcohol testing in <br />accordance with the customer’s drug and alcohol testing policy.
