73 <br />The employee must be qualified for the position to which they are being demoted or <br />transferred. The City Council must approve this action. <br /> <br />E. Salary <br /> <br />An employee’s salary increase may be withheld or the salary may be decreased due to <br />performance deficiencies. <br /> <br />F. Dismissal <br /> <br />The City Administrator, with the concurrence of the City Council, may dismiss an <br />employee for substandard work performance, serious misconduct, or behavior not in <br />keeping with City standards. <br /> <br />If the disciplinary action involves the removal of a qualified veteran, who has completed <br />his/her initial probationary period, the appropriate hearing notice will be provided and all <br />rights will be afforded the veteran in accordance with Minnesota law. <br /> <br />Section 6.02 Grievance Procedure <br /> <br />Any dispute between an employee and the City relative to the application, meaning or <br />interpretation of these personnel policies will be settled in the following manner: <br /> <br />Step 1: The employee must present the grievance in writing, stating the nature of the <br />grievance, the date at which the incident allegedly occurred, the facts on which it is based, <br />the provision or provisions of the personnel policies allegedly violated and the remedy <br />requested, to the proper supervisor within 21 days after the alleged violation or dispute <br />has occurred. The supervisor will respond to the employee in writing within seven (7) <br />calendar days. <br /> <br />Step 2: If the grievance has not been settled in accordance with Step 1, it must be <br />presented in writing, stating the nature of the grievance, the date at which the incident <br />allegedly occurred, the facts on which it is based, the provision or provisions of the <br />Personnel Policies allegedly violated, and the remedy requested, by the employee to the <br />City Administrator within seven (7) days after the supervisor’s response is due. The City <br />Administrator or his/her designee will respond to the employee in writing within seven (7) <br />calendar days. <br /> <br />Step 3: If the grievance has not been settled in accordance with Step 2, it must be <br />presented in writing, stating the nature of the grievance, the date at which the incident <br />allegedly occurred, the facts on which it is based, the provision or provisions of the <br />Personnel Policies allegedly violated, and the remedy requested, by the employee to the <br />City Council within seven (7) days after the City Administrator’s response is due. The <br />City Council will respond to the employee’s grievance in writing in due course.
