<br />*City of Mounds View* <br />DOT Drug -Free Workplace Policy 2020 Version 10 <br /> <br /> <br />⇒ No driver shall report for duty or remain on duty requiring the performance of safety- <br />sensitive functions when the driver uses any drugs, except when the use is pursuant to <br />the instructions of a licensed medical practitioner who has advised the driver that the <br />drug will not adversely affect the driver’s ability to safely operate a CMV. <br /> <br />⇒ No employer having actual knowledge that a driver has used a controlled substance <br />shall permit the driver to perform or continue to perform a safety-sensitive function. <br /> <br />⇒ An employer may require a driver to inform the employer of any therapeutic drug use. <br /> <br />⇒ No driver shall report for duty, remain on duty or perform a safety-sensitive function if <br />the driver tests positive for controlled substances. No employer having actual <br />knowledge that a driver has tested positive for controlled substances shall permit the <br />driver to perform or continue to perform safety-sensitive functions. <br /> <br />⇒ No driver shall refuse to submit to a drug test required pursuant to DOT regulations. <br /> <br />Alcohol Prohibitions: <br />The regulations prohibit any alcohol use that could affect performance of a safety-sensitive function. <br />Listed below are the prohibitions with respect to alcohol use. <br /> <br />⇒ No driver shall report for duty or remain on duty requiring the performance of safety- <br />sensitive functions while having an alcohol concentration of 0.02 or greater. No <br />employer having actual knowledge that a driver has an alcohol concentration of 0.02 or <br />greater shall permit the driver to perform or continue to perform safety-sensitive <br />functions. <br /> <br />⇒ No driver shall use alcohol while performing safety-sensitive functions or perform such <br />functions within four (4) hours after using alcohol. No employer having actual knowledge <br />that a driver has used alcohol while performing safety-sensitive functions, or used <br />alcohol within four (4) hours immediately preceding the performance of such functions, <br />shall permit a driver to perform or continue to perform safety-sensitive functions. <br /> <br />⇒ No driver required to take a post-accident alcohol test shall use alcohol for eight (8) <br />hours following the accident, or until he/she undergoes a post-accident alcohol test, <br />whichever occurs first. <br /> <br />⇒ No driver shall refuse to submit to an alcohol test required pursuant to DOT regulations. <br /> <br />NOTE: A regulated employee found to have an alcohol concentration of 0.02 or greater but less than <br />0.04 shall not perform, nor be permitted to perform, safety-sensitive functions for at least twenty-four <br />(24) hours. <br /> <br />CONSEQUENCES FOR POLICY VIOLATIONS <br /> <br />Removal from Safety-Sensitive Function: <br />Employees and applicants shall not perform, nor be permitted to perform, a safety-sensitive function, <br />including driving a commercial motor vehicle as previously defined in this Policy, if any of the above <br />prohibitions, or the drug and/or alcohol rule of another DOT agency, are violated.
