Item No : 08D <br />Meeting Date: June 8, 2020 <br />Type of Business: Council Business <br />City Administrator Review: _____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Jon Sevald, Community Development Director <br />Item Title/Subject: Resolution 9285; Approving or Denying Property Owner’s <br />Appeals Related to the Quincy Street Reconstruction Project <br /> <br /> <br />Introduction: <br />As part of the Quincy Street reconstruction project, Staff notified 12 property owners <br />with non-conforming driveways that the City would re-install driveway aprons to be <br />conforming to City Code. Property owners have the option to appeal Staff’s decisions to <br />the City Council by Friday, June 5th. This Staff Report includes those appeals received <br />by Wednesday June 3rd. If others were received, Staff will provide an update at the <br />June 8th Council meeting. <br /> <br />Discussion: <br />During street reconstruction projects, it is the intent that all non-conforming driveways <br />be made conforming as much as practical, and provides Staff the authority to make <br />these decisions.1 Driveway aprons less than 5’ from the side yard property lines will be <br />re-install ed with a 5’ setback. Driveway aprons wider than 24’ will be re-installed no <br />wider than 24’. If there is a second driveway curb cut, the City will remove the curb cut <br />and that portion of the driveway within the right-of-way. That portion outside of the right- <br />of-way, would be left as a patio or parking pad for vehicles not used on a regular basis. <br /> <br /> <br /> <br /> <br /> <br />1 City Code, Section 1121.09, Subd f(g); g. In conjunction with street improvement projects or in conjunction with <br />individual driveway replacement projects, nonconforming curb cuts shall be made conforming to whatever extent <br />practicable. If, in the opinion of the directors of public works and community development, a nonconforming curb <br />cut cannot be made conforming without undue hardship or disruption to the property, the curb cut may remain in <br />existence, unchanged. Decisions regarding curb cuts may be appealed in writing to the City Council. (Added, <br />Ord. 756, 1-24-05)
