Item No : 05C <br />Meeting Date: June 22, 2020 <br />Type of Business: Council Business <br />City Administrator Review: _____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Jon Sevald, Community Development Director <br />Item Title/Subject: Resolution 9287; Approving Appeal of Nonconforming <br />Driveway Related to the Quincy Street Reconstruction <br />Project for 5386 Quincy Street <br /> <br />Discussion: <br />During street reconstruction projects, it is the intent that all non-conforming driveways <br />be made conforming as much as practical, and provides Staff the authority to make <br />these decisions.1 As part of the Quincy Street project, Staff notified 12 property owners <br />with non-conforming driveways that the City would re-install driveway aprons to be <br />conforming to City Code. Four property owners appealed Staff’s decisions, and were <br />considered by the City Council at its June 8th meeting. The Council approved three <br />appeals, and tabled an appeal for 5386 Quincy Street, pending further research by <br />Staff. <br /> <br />Based on the Council’s June 8th discussion, the attached drawing would reduce the curb <br />cut opening from 29’ to 24’, but preserve the 0’ side yard setback2 behind the sidewalk. <br /> <br />Strategic Plan Strategy/Goal: <br />N/A <br /> <br />Financial Impact: <br />None. <br /> <br />Recommendation: <br />Staff recommends that driveway aprons be installed to comply with City Codes as much <br />as practical. <br /> <br />Respectfully, <br /> Jon Sevald, AICP <br />Community Development Director <br /> <br />ATTACHED <br />Photo & Plan <br />Resolution 9287 <br /> <br />1 City Code, Section 1121.09, Subd f(g); g. In conjunction with street improvement projects or in conjunction with <br />individual driveway replacement projects, nonconforming curb cuts shall be made conforming to whatever extent <br />practicable. If, in the opinion of the directors of public works and community development, a nonconforming curb <br />cut cannot be made conforming without undue hardship or disruption to the property, the curb cut may remain in <br />existence, unchanged. Decisions regarding curb cuts may be appealed in writing to the City Council. (Added, <br />Ord. 756, 1-24-05) <br />2 City Code, Section 1104.01, Subd 4(b)(1) Driveways shall have a minimum setback of five feet (5’) from any lot <br />line, except as permitted in Section 1121.15, subdivision 2 of this Title.
