The LGU finds the wetland boundaries illustrated in the attached figure titled: Revised Figure 2 - Existing <br />Conditions by Kjolhaug Environmental Services, undated (RCWD received 10/15/2018), accurate and <br />supported by the submitted wetland delineation for the LGU administration of the WCA. <br />The local government unit decision is valid for five years. However, the decision will cease to be valid <br />before then, if the Technical Evaluation Panel determines that the wetland boundary or type has changed <br />due to natural or artificial changes to the hydrology, vegetation, or soils of the area. The LGU finds that <br />the wetland typing may need to be reviewed in conjunction with any future project. The applicant needs <br />to submit a survey of the wetland boundary as well as gps points of the wetland delineation in a form <br />acceptable to the RCWD. <br />Advisory Note: <br />A Wetland Replacement Plan application must include a statement from the MnDNR, or the applicant's <br />licensed professional, based on MnDNR database review, as to the potential presence of an endangered or <br />threatened species or potential impact to a rare natural community (Minn. Rules 8420.0330, subp. 3.A(5); <br />8420.0525). Applicants should initiate this review early. <br />For Replacement Plans using credits from the State Wetland Bank: <br />Bank Account # Bank Service Area County Credits Approved for <br />Name Title <br />Phil Belfiori <br />Withdrawal (sq. ft. or nearest .01 <br />Signature r Date Phone Number and E-mail <br />acre) <br />Replacement Plan Approval Conditions. In addition to any conditions specified by the LGU, the <br />approval of a Wetland Replacement Plan is conditional upon the following: <br />Financial Assurance: For project -specific replacement that is not in -advance, a financial <br />assurance specified by the LGU must be submitted to the LGU in accordance with MN Rule <br />8420.0522, Subp. 9 (List amount and type in LGU Findings). <br />Deed Recording: For project -specific replacement, evidence must be provided to the LGU that <br />the BWSR "Declaration of Restrictions and Covenants" and "Consent to Replacement Wetland" <br />forms have been filed with the county recorder's office in which the replacement wetland is located. <br />Credit Withdrawal: For replacement consisting of wetland bank credits, confirmation that <br />BWSR has withdrawn the credits from the state wetland bank as specified in the approved <br />replacement plan. <br />Wetlands may not be impacted until all applicable conditions have been met! <br />LGU Authorized Simature: <br />Signing and mailing of this completed form to the appropriate recipients in accordance with 8420.0255, <br />Subp. 5 provides notice that a decision was made by the LGU under the Wetland Conservation Act as <br />specified above.
