It is set back 26' whereas it should <br />be 30'. The adjacent properties to the south are single-family residential. Along the property <br />line, there is a chain -link fence, and a few trees. Additional trees and shrubs will be added. <br />There is a 5' to 6' difference in topography between the planned parking lot and adjacent back <br />yards (back yards are lower). <br />An alternative to the Variance is to maintain a 30' setback, and expand the parking lot to the <br />east. This would decrease the useable area of the play fields behind the school. Thus, <br />decreasing the side yard setback has a lesser impact for the school and its students. <br />Summary <br />Additions are proposed to Pinewood Elementary School, including reconfiguration of its parking, <br />and an expansion of its south parking lot to accommodate busses. This expansion necessitates <br />reducing the south side yard setback from 30' to 20' for the parking lot. <br />Recommendation <br />Staff Recommends that the Commission open the Public Hearing for public comments, and <br />close the Hearing. <br />Staff recommends approval of the Variance contingent upon complying with the conditions in <br />Resolution 1114-20. Staff also recommends the Commission consider if additional screening is <br />needed between the parking lot and south property line, with the intent of screening headlights <br />from the adjacent residences. <br />A simple majority vote is needed to approve a Variance; e.g. 5 of 7 Commissioners, or 4 of 6, or <br />3of5,or3of4. <br />The Planning Commission is requested to consider the following options: <br />City Code, Section 1104.01, Subd 4(c)(2)(b)(ii): Non-residential uses: Parking lots and driveways shall be set back <br />five feet (5') except where non-residential uses abut property in a residential district, the setback for parking <br />areas from the common property line shall be as follows: [ii]. for sites having more than two and one-half (2.5) <br />acres: thirty feet (30'). <br />In 2001, the School District applied for a Variance for a 0' setback for parking along Quincy Street. The Variance <br />was neither approved nor denied, but resolved via a Limited Use Agreement pertaining to the west parking lot <br />encroaching into the Quincy Street right-of-way. Exhibit B of the Agreement states "Maximum Encroachment <br />Width Not To Exceed 7 Feet". The proposed site plan eliminates the parking lot along Quincy Street, thus, <br />negates the 2001 Limited Use Agreement. <br />
