1301.03 1301.03 <br />1301.03: ESTABLISHMENT OF OVERLAY ZONING DISTRICTS: <br />Subd. 1. Districts: The City establishes the following overlay zoning classifications within <br />the City: <br />a. Floodway District. The Floodway District shall include those areas designated as <br />"Zone AE", "Zone AH" and "Zone A" on the Flood Insurance Rate Map panels adopted <br />in Section 1301.02, subdivision 2 of this Chapter that are below the ordinary high water <br />level as defined in Minnesota Statutes, Section 103G.005, subdivision 14. <br />b. Flood Fringe District. The Flood Fringe District shall include those areas <br />designated as "Zone AE", "Zone AH" and "Zone A" on the Flood Insurance Rate Map <br />panels adopted in Section 1301.02, subdivision 2 of this Chapter that are below the one <br />percent (1 %) annual chance flood elevation (100-year flood elevation) but above the <br />ordinary high water level as defined in Minnesota Statutes, Section 103G.005, <br />subdivision 14. (See Section 1301.06 of this Chapter for the procedures to determine the <br />one percent (1%) annual chance flood elevation (100-year flood elevation)). <br />Subd. 2. Compliance: No person shall use a new structure or land and no person shall <br />construct, locate, extend, convert or structurally alter a structure without meeting the <br />terms of this Chapter and all other applicable rules and regulations. Within the <br />Floodway, Flood Fringe and General Flood Plain Districts, the City prohibits all uses not <br />listed as permitted uses or conditional uses in Sections 1301.04 and 1301.05 that follow, <br />respectively. In addition, the following provisions shall apply: <br />a. New manufactured homes, replacement manufactured homes and certain travel <br />trailers and travel vehicles are subject to the general provisions of this Chapter and to the <br />standards in Section 1301.09 of this Chapter. <br />b. Modifications, additions, structural alterations, normal maintenance and repair, or <br />repair after damage to existing nonconforming structures and nonconforming uses of <br />structures or land are regulated by the general provisions of this Chapter and to the <br />standards in Section 1301.11 of this Chapter. <br />C. As -built elevations for elevated or flood -proofed structures must be certified by <br />ground surveys. A licensed professional engineer or architect must design and certify <br />flood -proofing techniques as specified in the general provisions of this Chapter and as <br />stated in Section 1301.10 of this Chapter. <br />City of Mounds View <br />
