1303.05 <br />1303.06 <br />1303.05: CONFLICT WITH OTHER LAWS: If the requirements of this Chapter are in <br />conflict with any other law, the stricter requirements shall be enforced. <br />1303.06: LAND DISTURBANCE PERMIT: <br />Subd. 1. PERMIT APPLICABILITY: Except as exempted in subdivision 4 of this Section, <br />no person shall conduct any land disturbance activity without first obtaining a Land <br />Disturbance permit from the City. A separate shall be required for each site or common <br />plan of development or sale, and may cover both excavations and fills. Any changes or <br />deviation from previously reviewed plans require an amended permit be applied for and <br />approved before the work is performed. <br />Subd. 2. LAND DISTURBANCE PERMIT FEES: A fee for each land disturbance permit <br />shall be paid to the City as established by resolution of the City Council. <br />Subd. 3. EXPIRATION: Every permit issued by the City under the provisions of this <br />Chapter shall expire by limitation and become null and void if the work authorized by <br />such permit is not commenced within ninety (90) days from the date of issuance of such <br />permit, or if the work authorized by such permit is suspended or abandoned at any time <br />after the work is commenced for a period of one hundred eighty (180) days. Before such <br />work can be recommenced, a new permit shall be first obtained to do so, and the fee <br />therefore shall be one-half the amount required for a new permit for such work, provided <br />no changes have been made or will be made in the original plans and specifications for <br />such work; and provided further that such suspension or abandonment has not exceeded <br />one (1) year. In order to renew action on a permit after expiration, the permittee shall pay <br />a new full permit fee. Any permittee holding an unexpired permit may apply for an <br />extension of the time within which the permittee may commence work under that permit <br />when the permittee is unable to commence work within the time required by this Section <br />for good and satisfactory reasons. The City may extend the time for action by the <br />permittee for a period not exceeding one hundred eighty (180) days upon written request <br />by the permittee showing that circumstances beyond the control of the permittee showing <br />that circumstances beyond the control of the permittee have prevented action from being <br />taken.
