Item 05B <br />Page 2 of 9 <br /> <br />The Mounds View Vision <br />A Thriving Desirable Community <br /> <br /> <br /> <br />In 2005, A Variance was approved for PAK to reduce the driveway setback, from 5’ to 1’ (Res. <br />810-05). Between 2004 and 2007, disputes occurred between representatives of the PAK <br />property and Velmeir/CVS regarding drainage and easements. <br /> <br />In 2005, the PAK building became vacant. City files include 2006-2009 history of parties <br />interested in acquiring the PAK property, including; Anytime Fitness, a baseball/softball training <br />facility; gun shop; thrift store; bike shop; computer repair; an Italian-American Club, restaurant; <br />retail strip mall (with the Simons property), carpet store. PAK’s representative was <br />unresponsive to all inquiries. In 2011, the property entered foreclosure. <br /> <br />In 2012, C & N Group, LLC (Tires N’More) purchased the property and obtained a CUP for <br />Minor Auto Repair (Res 7984), with conditions of installing a 6’ fence along the western property <br />line, constructing a parking lot, and complying with the Fire Marshal’s orders. In 2013, a <br />Variance was approved allowing parking lot setbacks to be; front; 5’; east; 0’ west front-half; 0’ <br />(Res 995-13). At that time, there was no driveway access along the east side of the Tires <br />N’More building from front to back. Between 2012 and 2019, the City issued various violation <br />orders related to tire storage and miscellaneous zoning violations. In 2019, the CUP was <br />revoked, in part due to these violations (Res. 9108). <br /> <br /> <br />Strategic Plan Strategy/Goal: <br />Create and maintain a positive business climate where businesses want to locate and remain in <br />Mounds View. <br /> <br /> <br />Financial Impact: <br />(none) <br /> <br /> <br />Staff Recommendation: <br />Staff recommends approval of Resolution 1122-20, approving a Conditional Use Permit for <br />Open and Outdoor Storage, including replacing the existing western 6’ wooden fence, with an 8’ <br />fence to match the proposed 8’ eastern fence. <br /> <br />The Planning Commission is requested to consider the following options: <br /> <br />1. Approve Resolution 1122-20, Recommending Approval of a Conditional Use Permit for <br />Open and Outdoor Storage as an Accessory Use. <br /> <br />2. Recommend Denial of Resolution 1122-20, with Findings. <br /> <br />3. Table the request. If additional information is needed before a decision can be made, <br />the Commission may Table the request until such information is provided. Because of <br />the 60-Day Rule (deadline: November 18, 2020), this would need to come back to the <br />Commission at its October 21st or November 4th meeting, or Staff may extend the City’s <br />review past 60-Days by providing notice and reasoning to the applicant. <br /> <br />A Public Hearing is scheduled for the October 12, 2020 City Council meeting. Notice was <br />published in the September 29, 2020 Shoreview Press, and mailed to property owners within <br />350’ of the subject property. <br /> <br />
