The applicant’s hardship is that the attached garage is too <br />close to the property line. If the addition were built at the 30’ setback, it would look awkward. <br /> <br /> <br />The Planning Commission is requested to conduct a Public Hearing, and consider the following options: <br /> <br />1. Approve Resolution 1122-20, approving a Variance to reduce the front (side) yard setback, from 30’ <br />to a distance equal to the existing attached garage (approximately 26’ – 27’). <br /> <br />2. Deny Resolution 1122-20, with Findings. <br /> <br />3. Table the request. If additional information is needed before a decision can be made, the <br />Commission may Table the request until such information is provided. Because of the 60-Day Rule <br />(deadline: December 2, 2020), this would need to come back to the Commission at its November <br />18th or December 2nd meeting, or Staff may extend the City’s review past 60-Days by providing <br />notice and reasoning to the applicant. <br /> <br />A Public Hearing notice was published in the October 13, 2020 Shoreview Press, and mailed to property <br />owners within 350’ of the subject property. <br /> <br />Staff received a voicemail from an anonymous person, who did not object to the Variance, but <br />expressed concerns about the number of vehicles parked on the property, and concerns about the <br />garage being used as a business. <br /> <br />Home Occupations are a permitted use 7, such that (paraphrased); it is conducted within the residential <br />structure; is compatible with the neighborhood; does not involve employees other than persons residing <br />in the home; does not alter features typical of a home; does not have exterior storage; does not <br />generate on-street parking; does not create a nuisance; and does not involve an activity visible from the <br />street. <br /> <br />Respectfully, <br /> Jon Sevald, AICP <br />Community Development Director <br /> <br />Attachments <br />1.
