Res 9381 <br />Page 2 of 3 <br />WHEREAS, the applicant intends to apply to subdivide a portion of Lot 3, Block 1 of <br />Anthony Properties ("Parking"), commonly known as the movie theater's parking lot; and for a <br />Development Review for a Drive-Thru Restaurant to be located in the parking lot. Prior to <br />proceeding with design costs, the applicant is requesting approval to allow Drive-Thru <br />Restaurants as an Allowed Use on Lot 3; and, <br />WHEREAS, the Mounds View Planning and Zoning Commission reviewed the request <br />at its January 6, 2021 meeting, recommending approval (Resolution 1128-21); and, <br />WHEREAS, the City Council held a Public Hearing on Monday, January 25, 2021 at <br />6:30 PM. A Public Hearing Notice was published in the January 5, 2021 edition of the <br />Shoreview Press, and mailed to property owners within 350' of the subject property; and, <br />WHEREAS, the Mounds View City Council has reviewed the Applicant's request to <br />amend the PUD Narrative, the Staff Report, and in consideration of public testimony, makes the <br />following Findings: <br />Findings: <br />The property is zoned Planned Unit Development (PUD), and guided Regional <br />Commercial (RC) in the current Comprehensive Plan (2010). The property is guided <br />Mixed Use in the Draft Comprehensive Plan (2040). Drive-thru restaurants are not <br />specifically addressed in the Draft Comprehensive Plan. The Mixed Use designation <br />intends for development to occur as a PUD, with a 60/40 % residential/commercial mix. <br />A restaurant is consistent with this commercial mix. <br />2. Lot 2, Block 2 of Anthony Properties, labeled as "Parcel B" in the PUD Narrative, <br />currently includes a drive-thru restaurant (Subway). The proposed addition of a drive- <br />thru restaurant such as a coffee shop, on Lot 3, Block 1, labeled "Parking" (e.g. theater's <br />parking lot) in the PUD Narrative, is consistent with allowed uses elsewhere in this PUD. <br />3. The Mounds View Municipal Code, Section 1120.04 provides the procedure for <br />approving a Planned Unit Development, including submittal of a detailed General <br />Concept Plan, Development Stage, and Final Plan. These plans were approved in 1998 <br />(Resolutions 5119 and 5226), and amended in 2002 and 2003 (Resolutions 5803 and <br />5997). It is the intent that any development of a restaurant or drive-thru restaurant shall <br />comply with the Municipal Code, and be consistent with the PUD Narrative as amended. <br />NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council, based <br />upon the above Findings, the Staff Report, and in consideration of public testimony, hereby <br />Approves an Amendment to the Planned Unit Development Narrative of the O'Neil Property; <br />adding "Drive-Thru Restaurants" as an Allowed Use on Lot 3, Block 1 of Anthony Properties, <br />commonly known as the movie theater parking lot, with the following conditions: <br />1. All Allowed Uses listed in the PUD Narrative shall be Permitted Uses, according to the <br />Mounds View Municipal Code unless further restricted by the PUD Narrative.
