RESOLUTION 9395 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />AUTHORHIZING EXCUTION OF TOLLING AGREEMENT <br />WITH S HANK CONSTRUCTION — CONTACTOR <br />FOR MUNICIPAL WATER SYSTEM REHABILIATION <br />WHEREAS, The City of Mounds View is under contract with Shank Construction <br />for the rehabilitation of our Municipal Water System; and <br />WHEREAS, Shank Construction is working towards completion of Phase 1 with a <br />substantial completion date of June 30, 2021; and <br />WHEREAS, staff concerns regarding completion date in time for Phase II <br />completion subsequently tied to bond sales requirements, and <br />WHEREAS, Shank Construction and the City of Mounds View agree to execute a <br />Tolling Agreement which sets aside concerns, focuses on completion, but preserves <br />contractual remedies for disagreements or concerns. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds <br />View, Ramsey County, Minnesota as follows: <br />1. The Mayor and/or City Administrator is hereby authorized and directed to <br />execute all appropriate documents to effectuate the actions contemplated by <br />this resolution. <br />2. The Mayor and/or City Administrator, Staff and consultants are hereby <br />authorized and directed to take any and all additional steps and actions <br />necessary or convenient in order to accomplish the intent of this Resolution. <br />Adopted this 8t' day of February, 2021 <br />ATTEST: <br />Carol A.
