RESOLUTION NO. 9462 <br />CITY OF MOUNDS VIEW, MINNESOTA <br />A RESOLUTION REQUESTING A VARIANCE FROM STREET DESIGN <br />STANDARD FOR STATE AID OPERATION FOR PROJECT NO. S.A.P. 146-244-001 <br />WHEREAS, the City of Mounds View is preparing plans for MSAH 244 Spring Lake <br />Road beginning at 73rd Ave NE and ending at West County Road J (excluding segment of <br />roadway from Hillview Road to County Road 10); and <br />WHEREAS, Minnesota Rules for State Aid Operation 8820.9936 require minimum <br />design speed of 30 mph; and <br />WHEREAS, the reasons for this variance request are based on one existing horizontal <br />design curve within the right of way which meets a design speed of 20 mph. Challenges <br />prompting this variance request include the existing offset location of the roadway within the <br />Right of Way, existing Right of Way width, proximity of Spring Lake, proposed typical section, <br />and potential needs for Right of Way acquisition. <br />NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Mounds <br />View, Ramsey County, Minnesota that the City requests a variance from the Minnesota <br />Department of Transportation State Aid Operations Rules Chapter 8820.9936 (Minimum <br />Design Standards, Urban; New or Reconstruct Projects) to allow a 20 mph minimum design <br />speed in lieu of a 30 mph design speed. <br />BE IT FURTHER RESOLVED, by the City Council of the City of Mounds View, <br />Ramsey County, Minnesota that the City hereby indemnifies, saves and hold harmless the <br />State of Minnesota and its agents and employees of and from claims, demands, actions, or <br />causes of action arising out of or by reason of (project descriptions) in accordance with <br />Minnesota Rules 8820.9936 and further agrees to defend at their sole cost and expense any <br />action or proceeding commenced for the purpose of asserting any claim arising as a result of <br />the granting this variance. <br />BE IT FURTHER RESOLVED, by the City Council of the City of Mounds View, <br />Ramsey County, Minnesota that the Mayor and City Administrator are hereby authorized and <br />directed to take all necessary action and to execute all appropriate documents to effectuate the <br />action contemplated by this Resolution. <br />BE IT FINALLY RESOLVED, by the City Council of the City of Mounds View, Ramsey <br />County, Minnesota that the Mayor, City Administrator, City Attorney, staff and consultants are <br />hereby authorized and directed to take any and all additional steps and actions necessary or <br />convenient in order to accomplish the intent of this Resolution. <br />Adopted this 23rd day of August, 2021 <br />ATTEST: <br />(SEAL) <br />The Mounds View Vision <br />4 lhririn' Destrubb� Coni nnnitu <br />Carol A.
