Item No: 081 <br />Meeting Date: Aug 23, 2021 <br />-� Type of Business: Council Business <br />MOV1 SIDS VIEW City Administrator Review: <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Jon Sevald, Community Development Director <br />Item Title/Subject: Resolution 9464, Approving the Final Plat of Anthony Properties <br />Second Addition (Planning Case MU2021-001) <br />Introduction: <br />Java Companies is requesting approval of the Final Plat of Anthony Properties Second Addition, <br />subdividing the parking lot of AMC Classic 15 Mounds View into three lots; (1) Caribou Cabin; <br />(2) theater parking lot; and (3) additional parking for Moe's. <br />Discussion: <br />Anthony Properties was approved as a Planned Unit Development (PUD) in 1998, and <br />subdivided in 1999. As a PUD, lot sizes and setbacks are customized to the project. This <br />project requires approvals of; (1) Subdivision; (2) Amendment to the PUD Narrative; and (3) <br />Development Review of the coffee shop. The PUD Narrative was amended, and the <br />Development Review was approved on July 12, 2021 (Resolution 9443). <br />The project subdivides the movie theater's parking lot into three lots: <br />Lot 1 0.55 acres Caribou Cabin <br />Lot 2 3.56 acres AMC Classic 15 Mounds View (parking lot) <br />Lot 3 0.25 acres Moe's (additional parking) <br />Since the Preliminary Plat was approved (Resolution 9443), changes have been made to the <br />grading & drainage plan to comply with RCWD requirements. These include raising the <br />building's low floor elevation 3', thereby adding a 2'-Y retaining wall east of the building; moving <br />the sidewalk connection to the trail because of the retaining wall; replacing the eastern <br />stormwater infiltration basin with underground storage; and increasing the western basin (wider <br />and shallower (2' depth). <br />The Landscaping Plan (June 11, 2021) needs to be updated to reflect the August 3, 2021 Civil <br />Plans. The Resolution includes a condition requiring this prior to any land disturbance or <br />issuance of a Building Permit, and provides Staff discretion in approving the plan <br />administratively. <br />Analysis: <br />Prelim Plat' The Final Plat is consistent with the approved Preliminary Plat, pending <br />administrative approval of the Landscaping Plan. <br />Plat Opinion The City Attorney has provided a Plat Opinion. The Owner (AP Mounds View) is <br />requesting to amend the 1999 Declaration of Easements and Restrictions <br />regarding maintenance and cost sharing amongst the three property owners. <br />The Resolution authorizes the Mayor and City Administrator to sign this <br />amendment, if and when the City Attorney advises to do so. <br />' Mounds View Municipal Code § 158.026(B) (Conformance to preliminary plat) <br />2 Mounds View Municipal Code § 158.026(D) (Plat Opinion; Title Insurance) <br />
