Item 08B <br />Page 3 of 6 <br />It is Staff's opinion that the need for the Variance is caused by the temperament of the <br />Applicant's dogs. The fence as constructed is 6' in height nearest to the front door steps, and is <br />4' otherwise around the front yard. If the applicant is concerned that the dogs will jump from the <br />front steps over a 4' fence, then the applicant can move the 4' fence further away from the front <br />steps. Staff agrees with the Applicant that the corner lot is unique because over half of the rear <br />yard consists of the garage and driveway, leaving a grassy area for the dogs to run behind the <br />garage, which is not viewable from within the house because the garage blocks the view. <br />Therefore, the front yard and the front (side) yard is the most practical area for the dogs. The <br />front (side) yard along County Road H is not fenced, but would allow a 6' fence behind the front <br />of the house (see attached "Allowable Fence Height). <br />Staff has prepared a Resolution for Approval / Denial of the Appeal (Circle one, cross out the <br />other). The Planning Commission's Findings for Denial are numbered 1 and 4 on the <br />Resolution. The Council is asked to consider if one or both Findings were in error.
