M0U__N_DitSVV!rW <br />City of Mounds View Staff Report <br />Item No: 08A <br />Meeting Date: November 8, 2021 <br />Type of Business: Council Business <br />City Administrator Review: <br />To: Honorable Mayor and City Council <br />From: Nyle Zikmund, City Administrator <br />Item Title/Subject: Ordinance No. 983, Proposed 2022 City of Mounds View <br />Fee Schedule <br />Introduction: <br />The Mounds View Fee Schedule is reviewed by Staff on an annual basis to keep pricing <br />and fees current. This review often results in necessary additions, deletions, adjustments <br />or increases. <br />Discussion: <br />As you are aware, fee schedules are typically approved by resolution. However, we <br />have learned that the League of Minnesota Cities suggests that cities adopt all fees <br />annually by ordinance because state laws requires this for some city fees. For <br />example, when a City is authorized to do something by ordinance, then any fee charged <br />or involved with that ordinance action must be adopted by ordinance as well. In <br />addition, some fee established by resolution are not enforceable or collectable in court. <br />In bankruptcy cases, fees will not usually be awarded to a City if that fee was not <br />approved by ordinance (delinquent sewer and water bills are an example of this). <br />City Staff and the City Council, at their November 1, 2021, work session, reviewed the <br />draft 2022 Fee Schedule with no further revisions suggested. As shown in Attachment <br />A, proposed revisions in red strike -through are deletions and those in blue underline are <br />additions or modifications. <br />Recommendation: Staff recommends that the City Council conduct the first reading <br />and introduction of Ordinance No. 983.
