Note — This was the same process Fridley utilized to amend its levy provision in its Charter. <br />Charter Commission Resolution 2021-4: <br />At the September 21, 2021 Charter Commission meeting, the Charter Commission adopted <br />Resolution 2021-4 — RESOLUTION RECOMMENDING AMENDMENT OF THE MOUNDS VIEW <br />CHARTER BY ORDINANCE. <br />The City officially received receipt of the signed ordinance on October 25, 2021. <br />Minnesota Statutes, section 410.12, subdivision 7 process: <br />Once the Commission passes a resolution recommending an amendment to the Charter a specific <br />timeline must be followed. The timeline starts once the City receives the proposed amendment from <br />the Commission. The timeline is outlined below: <br />The Commission approved the recommendation to amend the Charter by ordinance on September <br />21, 2021: <br />1. The timeline begins when the City receives the recommendation from the Charter <br />Commission. <br />o Received October 25, 2021 <br />2. Within one month of receiving the recommendation, the City must publish notice of a public <br />hearing on the proposal and the notice must contain the text of the proposed amendment. The <br />text of the proposed amendment is taken from the Commission recommendation and cannot <br />be amended or changed by the Council. <br />o Proof of Publication on November 9, 2021 <br />3. The public hearing must occur between two weeks and one month after the notice is <br />published. <br />o Public Hearing Scheduled for December 13, 2021 <br />4. Within one month of the public hearing, the City Council must vote on the proposed charter <br />amendment ordinance. The ordinance passes only with an affirmative vote of all members of <br />the council. <br />5. If the ordinance passes, it must be published in the same manner as any other ordinance. <br />6. The ordinance will become effective 90 days after publication unless the following occurs: <br />o Within 60 days after publication, a petition requesting a referendum on the ordinance is <br />filed with the city clerk. <br />Impact of Proposed Change: <br />The resolution from the Charter Commission does not remove the levy restriction, rather; it <br />eases/increases it from the present 5% to 6.5% and allows for additional increases under the <br />following circumstances: <br />• Upon a 4/5t" vote of Council, the general levy may be increased another 2.5% to a total of total <br />of 9%. <br />If inflation exceeds 6.5% then, upon a 4/5t" vote of the Council the general tax levy may be <br />increase to the amount of inflation plus 2.5%. <br />The limits on increases to the general levy will be suspended for one year after the <br />decertification of a Tax Increment Financing District. <br />Since Section 7.03 was amended in 2008, Council has never levied the full 5% as the current <br />provision set the levy increase at 2% plus inflation.
