Mounds View City Council December 13, 2021 <br />Regular Meeting Page 8 <br /> <br />Council Member Meehlhause asked what would happen if there was a change of heart and the <br />Council were to support the conditional use permit. Community Development Director Sevald <br />stated the Council would have to reconsider the commercial kennel license at its next meeting. <br /> <br />Council Member Hull questioned if the City could limit the number of dogs on the property to <br />seven (7). Community Development Director Sevald stated this could be done. <br /> <br />MOTION/SECOND: Hull/Meehlhause. To Waive the Reading and Adopt Resolution 9495, <br />Approving a Conditional Use Permit for an Animal Boarding Facility at 5491 Adams Street <br />limiting the number of dogs to seven (7) and revising the fence area as discussed the applicant. <br /> <br />Council Member Bergeron stated he had no problem with the applicant or the way he runs his <br />business, rather he was concerned about the location of the proposed business not being a good fit <br />for the neighborhood. <br /> <br />Council Member Meehlhause commented he did not have an issue with the proposed kennel <br />license. He noted he would be supporting the proposed motion to approve the conditional use <br />permit. <br /> <br />Mayor Mueller asked if the outdoor area would be used for potty purposes and exercise. Mr. Holt <br />reported this was the case. He indicated he would be outside with the dogs at all times, noting <br />only one dog would be taken out at a time and a privacy fence would be installed. <br /> <br />Council Member Meehlhause questioned how the Planning Commission voted on this item. <br />Community Development Director Sevald reported the Planning Commission recommended <br />approval on a 6-0 vote. <br /> <br /> Ayes – 2 Nays – 3 (Bergeron, Cermak, and Mueller) Motion failed. <br /> <br />MOTION/SECOND: Bergeron/Cermak. To Waive the Reading and Adopt Resolution 9495, <br />Denying a Conditional Use Permit for an Animal Boarding Facility at 5491 Adams Street. <br /> <br /> Ayes – 3 Nays – 2 (Hull and Meehlhause) Motion carried. <br /> <br />F. Public Hearing: Introduction and First Reading of Ordinance 984, Charter <br />Commission Amendment Regarding Chapter 7, Levy Limits. <br /> <br />City Administrator Zikmund requested the Council introduce an Ordinance that would amend <br />Chapter 7 regarding Levy Limits. He explained out of the 785 cities in Minnesota, 102 have a <br />charter, noting only two have a levy provision within the Charter. He indicated the City of Mounds <br />View has the most restrictive Charter in the State of Minnesota. He commented in January of <br />2021, the Charter Commission began reviewing Chapter 7 and spent the majority of the year <br />addressing this task. He noted in September, the Charter Commission made a recommendation of <br />a Resolution that would amend Chapter 7 that eases the levy cap on a 6-3 vote. It was noted <br />Mounds View was in the lower 10% when considering the per capita levy. He indicated the levy <br />cap was suppressing the City’s ability to levy and hire additional staff.
