RESOLUTION NO.9565 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />A RESOLUTION ENACTED UNDER AUTHORITY OF MINNESOTA STATUTES <br />SECTION 12.29 AND 12.37 TO EXTEND THE PERIOD OF A MAYOR -DECLARED <br />LOCAL EMERGENCY AND AUTHORIZING EMERGENCY CONTRACTING TO <br />ADDRESS THE LOCAL EMERGENCY <br />WHEREAS, the Mayor of the City of Mounds View (the "City") has declared that a local <br />emergency is in effect in the City (the "Local Emergency"); and <br />WHEREAS, the City Council of the City of Mounds View (the "Council") finds that the <br />Local Emergency continues in the City and is in effect in the City until further action by the <br />Council, and that immediate action to respond to the Local Emergency is needed in order to protect <br />the health, safety and welfare of the City and the community; and <br />WHEREAS, the Council finds that the immediate purchase and procurement of materials <br />and labor related to the Local Emergency, including but not limited to lining, dewatering, by-pass <br />pumping, excavation, and repairs to the damaged components of the of the City's sewer system <br />and roadway, are necessary to ensure the City's sewer system is functioning properly; and <br />WHEREAS, Minnesota Statutes, sections 12.29 and 12.37 authorize the actions taken in <br />this resolution and provide that an emergency contract is not subject to the normal purchasing and <br />competitive -bidding requirements because of the Local Emergency. <br />NOW THEREFORE BE IT RESOLVED by the City Council of the City of Mounds <br />View, Minnesota, that the Local Emergency declared by the Mayor on March 14 related to the <br />failures in the City's sewer system is hereby extended until further action is taken by the Council <br />to terminate the Local Emergency. <br />NOW THEREFORE, BE IT FURTHER RESOLVED that the City Council, City staff, <br />and City consultants are hereby authorized and directed to purchase any necessary materials and <br />equipment and authorizes the contracting for such necessary materials and labor to respond to the <br />Local Emergency from vendors who are able to respond promptly. <br />NOW THEREFORE, BE IT FURTHER RESOLVED that the Council hereby <br />authorizes and directs the Mayor and City Administrator to execute any necessary contracts, <br />agreements and related documents regarding the local emergency and necessary to implement <br />corrective action relative to the Local Emergency and to protect the health, safety, and welfare of <br />the City and the community. <br />DOCSOPENWU 125\ 14\785537. v2-3/ 14/22 <br />
