• �'' •� <br />• y, <br />City of Mounds View Staff Report <br />Item No: 08A <br />Meeting Date: May 23, 2022 <br />Type of Business: Council Business <br />City Administrator Review: <br />To: Honorable Mayor and City Council <br />From: Nyle Zikmund, City Administrator <br />Item Title/Subject: Introduction and First Reading, Ordinance 991 Amending <br />Title XI, Chapter 110, Intoxicating Liquor, Relating to <br />Temporary On -Sale Intoxicating Liquor Licensing <br />Introduction: <br />The language in Chapter 110.017 of the Mounds View Municipal Code relating to <br />temporary on -sale intoxicating liquor licensing is inconsistent with State Statutes and <br />staff is recommending to align with the statute. <br />Discussion: <br />As you know, since 2014, the City of Mounds View has allowed the serving of alcoholic <br />beverages at the Festival in the Park. The Festival in the Park of Mounds View <br />contracts with a liquor catering service, such as a restaurant or bar, who currently holds <br />a full -year license with the City of Mounds View or any adjacent community. <br />The Festival in the Park has found a service, Maxx Bar and Grill, located in Ham Lake, <br />Minnesota, who is willing to cater the festival this year. However, because our City <br />Code contains the word, "adjacent", in its language, Maxx Bar and Grill is prohibited <br />from contracting with the Festival. <br />Staff would like to review and revise this portion of the Code by removing the word <br />"adjacent", and making other changes consistent with statute so that the Festival in the <br />Park of Mounds View can contract with any licensee that holds a full year on -sale <br />intoxicating liquor license with any municipality. Our requirement is stricter than what <br />state law allows, as MN Statute expressly provides that a temporary on -sale "license <br />may provide that the licensee may contract for intoxicating liquor catering services with <br />the holder of a full -year on -sale intoxicating liquor license issued by any municipality." <br />Staff Recommendation: <br />Staff recommends that the City Council introduce and conduct the first reading of <br />Ordinance No. 991.
