MOUNDS 1VIEVN <br />City of Mounds View Staff Report <br />Item No: 8.D. <br />Meeting Date September 12, 2022 <br />Type of Business: Council Business <br />Administrator review: <br />To: Honorable Mayor and City Council <br />From: Scott J Riggs, Kennedy & Graven, City Attorney <br />Item Title/Subject: Resolution 9631 Approving the Suspension of License for a Massage <br />Parlor <br />Background <br />The City of Mounds View issued an individual therapeutic massage license to Eric Roy Rautio <br />and an enterprise therapeutic massage license to Eric Roy Massages LLC on December 29th, <br />2021. Mr. Rautio has been running his business, Eric Roy Massages LLC, from his home <br />located at 8373 Groveland Court, Mounds View, MN for several years. <br />On August 26, 2022 the City Administrator Nyle Zikmund received an email from an attorney <br />representing a former client of Mr. Rautio, requesting that the City investigate and revoke Mr. <br />Rautio's massage therapy license. In an attached memorandum, the attorney stated that her <br />client was receiving a massage from Mr. Rautio when he digitally penetrated her vagina without <br />her consent. After she asked him to stop, Mr. Rautio informed the client that he was using a <br />"Yoni Massage" technique (yoni is a Sanskrit word that connotes female sexual organs). A <br />criminal complaint charging Mr. Rautio with 1 count of criminal sexual conduct in the third degree <br />stemming from this incident was filed by the Ramsey Count Attorney's office on May 27, 2022. <br />Discussion <br />Under Mounds View City Ordinance 114.014, the City Council may suspend or revoke a <br />therapeutic massage license subsequent to a public hearing, when the licensee violates a <br />provision of Subchapter 114. City Ordinance 114.001 (E) prohibits a therapist from intentionally <br />massaging, or offering to massage, a client's genitalia. The alleged behavior Mr. Rautio <br />engaged in is a clear violation of this ordinance. Further, this alleged behavior creates serious <br />safety concerns for the City if Mr. Rautio were to continue offering massages to clients. <br />Notice of a public hearing to take place during the September 12, 2022, Mounds View City <br />Council meeting was personally served on Mr. Rautio, sent to him via U.S. Mail, and emailed to <br />the email address provided on his license application on September 8th, 2022. <br />DOCSOPEN\MU125\65\822107.v3-9/8/22 <br />
