<br />Carter Johnson, being first duly sworn, on oath states as follows:
<br />1. I am the publisher of the SHOREVIEW PRESS, or the publisher's
<br />designated agent. I have personal knowledge of the facts stated in
<br />this Affidavit, which is made pursuant of Minnesota Statutes §331A.0T
<br />2. The newspaper has complied with all of the requirements to constitute a
<br />qualified newspaper under Minnesota law, including those requirements
<br />found in Minnesota Statutes §331A.02.
<br />The dates of the month and the year and day of the week upon which the
<br />public notice attached was published in the newspaper are as follows:

<br />newspaper complies with the conditions described in §580.033, subd. 1,
<br />clause (1) or (2). If the newspaper's known office of issue is located in
<br />a county adjoining the county where the mortgaged premises or some part
<br />of the mortgaged premises described in the notice are located, a substantial
<br />portion of the newspaper's circulation is in the latter county.

<br />AN ORDINANCE AMENDING SECTION 4.05, SUBDIVISION 1, OF
<br />THE CITY OF MOUNDS VIEW CHARTER PERTAINING TO VACANCIES
<br />IN MUNICIPAL ELECTED OFFICE
<br />THE CITY OF MOUNDS VIEW ORDAINS:

<br />1.01. The city of Mounds View ('City') Is governed by a home rule charter
<br />(the "City Charter"), adopted pursuant to the Constitution of the State of Min-
<br />nesota and Minnesota Statutes, chapter 410 (the "Act').
<br />1.02. The Mounds View Charter Commission has proposed the adoption
<br />of an amendment to section 4.05 of the City Charter (the "Amendment") and
<br />recommended to the City Council that the Amendment be adopted by ordi-
<br />nance in the manner presorl bed by section 410,12, subdivision 7 of the Act.
<br />1.03. A public hearing on the Amendment was held on November 14.
<br />2022, by the Mounds View City Council otter publlsfied notice containing the
<br />text of the Amendment, as required by the Act. and all persons desiring to be
<br />heard with reference to the Amendment were heard at said public hearing.
<br />1.04. The Mounds View City Council finds and determines that it Is In the
<br />best interests of the City and its inhabitants that the Amendment be adopted.

<br />2.01. Section 4.05, subdivision 1, of the Mounds View City Charter is
<br />hereby amended by adding the doubie=up dl,Rd language and deleting the
<br />slrfeken language as follows:
<br />Subdivision 1. Who a vacancy In an elected office of the City occurs with
<br />365 days or more remaining in the term of the vacated office, there shall be
<br />a special election held within ninety days after the vacancy occurs to elect
<br />a successor to serve for the remainder of the unexpired term of the office

<br />except that if within.
<br />ithin slaty (60) days after, publication a petition requesting a
<br />referendum on this ordinance, signed by the number of registered voters of
<br />the City required by the Act Is flied with the City Clerk, this ordinance will not
<br />be effective until approved by 51% of the voters voting on the question of its
<br />adop lion at an election called by the Counoll for that purpose.
<br />2.03. On the effective date of the Amendment, the City Clerk is authorized
<br />and directed to fife copies of the Amendment with the Secretary of State of the
<br />State of Minnesota, the Ramsey County Recorder, and the City Cleric's office
<br />together with the certificate required by section 410.11 of the Act.
