Items No. 08 E, F, G <br />Staff Report <br />November 14, 2022 <br />The City officially received receipt of the signed resolutions on September 29, 2022. <br />Minnesota Statutes, section 410.12, subdivision 7 process: <br />Once the Commission passes a resolution recommending an amendment to the Charter a specific timeline <br />must be followed. The timeline starts once the City receives the proposed amendment from the Commission. <br />The timeline is outlined below: <br />The Commission approved the recommendations to amend the Charter by ordinance on September 20, 2021: <br />1. The timeline begins when the City receives the recommendation from the Charter Commission. <br />o All three recommendations were received September 29, 2022 <br />2. Within one month of receiving the recommendation, the City must publish notice of a public hearing on <br />the proposal and the notice must contain the text of the proposed amendment. The text of the proposed <br />amendment is taken from the Commission recommendation and cannot be amended or changed by the <br />Council. <br />o Proof of Publication for all three ordinances on October 25, 2021 <br />3. The public hearing must occur between two weeks and one month after the notice is published. <br />o Public Hearing Scheduled for November 14, 2022 <br />4. Within one month of the public hearing, the City Council must vote on the proposed charter amendment <br />ordinance. The ordinance passes only with an affirmative vote of all members of the council. <br />o The ordinances can be voted upon after the public hearing on November 14, 2022. <br />5. If the ordinance passes, it must be published in the same manner as any other ordinance. <br />6. The ordinance will become effective 90 days after publication unless the following occurs: <br />o Within 60 days after publication, a petition requesting a referendum on an ordinance is filed with <br />the city clerk. <br />Impact of Proposed Change: <br />The resolutions from the Charter Commission may be best described as minor as they align the charter with <br />State Statute and the Minnesota Constitution <br />Action Requested: <br />Hold three separate public hearings on Ordinances 994,995, and 996. Each public hearing must be opened, <br />held, and closed independent of the other two hearings.
