Resolution 9653
Page 2 of 3

DOCSOPEN\MU205\59\845472.v1-12/20/22 2

WHEREAS, and the City Council also moved to table the action on the Preliminary Plat
and PUD and Development Review until the written statement for denial of the Zoning Map
Amendment could be considered by the City Council at its regular meeting scheduled on
December 27, 2022; and

WHEREAS, the City Council hereby finds and determines as follows with respect to the
denial of the Applicant’s requests:

a. The Property is currently zoned R-1 Residential.

b. The rezoning of land is a policy decision the City Council must make upon considering a
number of factors, including, but not necessarily limited to, the zoning of surrounding
land, the types of uses that will be allowed on the land if it is rezoned, the impacts of
those uses in the area given the surrounding uses and the ability of the public
infrastructure and services to accommodate those uses;

c. The proposed use of the Property is rezoned as requested would conflict with the
residential uses in the area, including those residential uses that are directly to the east
and west of the Property and in other locations nearby;

d. The proposal requires too many deviations from the standards for planned unit
developments that are established in the City Code, including the following:
i. Increased density;
ii. Reduction in usable open space;
iii. Elimination of trees on the project site;
iv. Reduction in available parking from the established standard;
v. Reductions in setbacks; and
vi. Deviation from external building materials standards;

e. Rezoning of the Property from R-1 Single Family Residential to PUD Planned Unit
Development is not, for the reasons stated herein, in the best interests of the City or the
public health, safety, and welfare;

f. Having determined that rezoning the Property, as requested, is not appropriate, the
request to approve a preliminary plat for the Property to accommodate the 140-unit
apartment building, must also be denied; and

g. Having determined that rezoning the Property, as requested, is not appropriate, the PUD
and Developmental Review must also be denied.

NOW, THEREFORE, BE IT RESOLVED, by the city council of the City of Mounds
View, as follows:

1. The above set-forth preamble and recitals are incorporated into and made a part of
this Resolution and constitute the finds of the City Council concerning this matter.
