Mounds View City Council December 27, 2022 <br />Regular Meeting Page 3 <br />1 addresses the complaints that have been brought to the City and how future complaints will be <br />2 addressed by the Council. <br />3 <br />4 Council Member Meehlhause noted there were two typographical errors in the Resolution. He <br />5 requested staff correct these grammatical errors. <br />6 <br />7 MOTION/SECOND: Meehlhause/Cermak. To Waive the Reading and Adopt Resolution 9682, <br />8 Approval of Business License Renewal — Curbside Waste, Inc. <br />9 <br />10 Council Member Hull questioned how the City would address complaints going forward. <br />11 Assistant City Attorney Sathe reported if a licensee fails to abide by the terms of the license and <br />12 City Code, the City can move forward with suspension and revocation. He explained City Code <br />13 requires that the Council provide an opportunity for the license holder to be heard before the <br />14 Council can take action to suspend or revoke the business license. <br />15 <br />16 City Administrator Zikmund indicated any complaints have to have verifiable evidence from <br />17 staff, whether this be from administrative staff, code enforcement or the police department. <br />18 <br />19 Mayor Mueller reported it was difficult to consider this action knowing it would have impacts on <br />20 Mounds View residents, but she did not see any other way to get a message across to the license <br />21 holder that they must follow the City Code noise ordinance rules. She hoped Curbside Waste <br />22 understood the rules in Mounds View were serious. <br />23 <br />24 Council Member Bergeron believed the Council was acting in good faith that Curbside Waste <br />25 would be following the contract as well as City Code going forward. <br />26 <br />27 Mayor Mueller explained two weeks ago the City Council approved all of the business licenses <br />28 in the City for 2023, with the exception of the business license for Curbside Waste. She reported <br />29 action was delayed to this meeting to ensure staff could speak with Curbside Waste about <br />30 complaints the City had receive regarding hours of operation/noise concerns. <br />31 <br />32 Deon Richardson, Curbside Waste representative, noted he had been communicating with City <br />33 Administrator Zikmund and explained the noise complaint concern had been addressed. He <br />34 reported Curbside Waste trucks now have cameras and GPS which meant any future complaints <br />35 could be addressed immediately. Mr. Richardson apologized for the driver that was starting work <br />36 at 6:00 a.m. and noted this would not occur in the future. <br />37 <br />38 Ayes — 5 Nays — 0 Motion carried. <br />39 <br />40 B. Approval of 2023 NYFS Contracts. <br />41 <br />42 City Administrator Zikmund requested the Council approve the 2023 contracts with Northeast <br />43 Youth and Family Services (NYFS). <br />44 <br />45 Council Member Meehlhause reported NYFS has been serving the community for the past 45 <br />
