Stat. §§ 13.871, subd. 6 (a), 626.53 <br />DESCRIPTION OF DATA: A report made by a health professional concerning a wound or <br />injury arising from or caused by discharge of a firearm or inflicted by the perpetrator of a crime <br />using a dangerous weapon other than a firearm is confidential data on individuals. <br /> <br />Safe at Home Program Data <br />CLASSIFICATION(S): Private <br />GOVERNING STATUTE: Minn. Stat. §§ 13.805 and 5B.07, subd. 1(b). <br />DESCRIPTION OF DATA: Identity and location data on a Safe at Home program participant <br />not otherwise classified by law are private data. “Program participant” means an individual <br />certified as a program participant under Minn. Stat. § 5B.03. “Identity and location data” means <br />any data used to identify or physically locate a program participant, including but not limited to <br />the program participant’s name, residential address, work address, and school address, and that is <br />collected received or maintained prior to the date a program participant’s certification expires, or <br />notice of withdrawal from the participant. Private or confidential identity and location data on a <br />program participant who submits a notice in writing that the participant is certified in the Safe at <br />Home address confidentiality program may not be shared with any other government entity or <br />disseminated to any person unless 1) the program participant has expressly consented in writing <br />to sharing the dissemination of the data for the purpose in which the sharing will occur; 2) the <br />data are subject to dissemination pursuant to a court order; 3) the data are subject to sharing <br />pursuant to Minn. Stat. § 5B.07, subd. 2; 4) the location data related to county of residence are <br />needed to provide public assistance or other government services, or to allocate financial <br />responsibility for the assistance or services; 5) the data are necessary to perform a government <br />entity's health, safety, or welfare functions, including the provision of emergency 911 services, <br />the assessment and investigation of child or vulnerable adult abuse or neglect, or the assessment <br />or inspection of services or locations for compliance with health, safety, or professional <br />standards; or 6) the data are necessary to aid an active law enforcement investigation of the <br />program participant. Regardless of whether certification has been submitted, the City must <br />accept the address designated by the Secretary of State as a program participant’s address and is <br />subject to the requirements contained in Minn. Stat. § 5B.05. <br /> <br />Sex Offender HIV Tests <br />CLASSIF ICATION(S): Private <br />GOVERNING STATUTE: Minn.
