Attachment 1 — Response to City Letter of July 11, 2019 Case File 62-CV-19-4965 <br />the public or I made aware that the Council intended to discussed removal of both <br />Commissioner Thomas and me at that meeting, which would have given me an opportunity to <br />speak to the issues. Council member Hull expressed his desire to have heard from <br />Commissioner Thomas and me that evening. <br />The listed agenda item was "Charter Commission Members." <br />The Letter states this was an agenda item on June 11, 2019. <br />• I disagree. <br />• The meeting was June 10, 2019. <br />• This item was a staff report, which did not allow public comments during the discussion. <br />The Letter states "substantive public input was given". <br />• I agree there was substantive positive public input, all of which supported Commissioner <br />Thomas and me. In additional the Council chamber was full with other supported citizens. <br />• The public comments were all in favor of Commissioner Thomas and me staying on the <br />Commission and questioning the Council motives. <br />• Comments were given by 12 people, (Attachment 8, Item 6 Public Comment). <br />• Mayor Mueller responded to the public comments at the June 10 meeting. She stated that "it <br />was like taking out pruning shears and shearing off some of the old growth to allow the younger <br />plants to thrive." The Commission is not a garden of the Council, nor are commissioners plants, <br />which I felt was disrespectful to Jonathan Thomas and me. Referring to us as "old growth" <br />seems to imply age discrimination. <br />The Letter states that after the June 11 meeting they met with 5 commissioners independently. <br />• At the June 10 meeting I agreed to attend a meeting that would be held with Commissioner <br />Thomas, the unnamed commissioners, the city administrator, and two council members. <br />• The June 10 meeting agreement with the Council was an approved motion. I understood the <br />approved motion (Attachment 8) was to discuss the Council's and "unnamed" commissioners <br />concerns. <br />• On the day of the meeting, June 18, I learned the meetings format was changed to private <br />separate meetings with individual commissioners. Unknown to me and without my agreement <br />the Council changed meeting format. In fact I showed up for the meeting at 3:30 and was <br />denied access to the meeting, told by City Administrator Zikmund this was Mr. Thomas meeting <br />time, and I should return in an hour for mine. <br />• My meeting on June 18 was with 3 council members (quorum) behind security keyed doors in <br />the city administrator's office with the door closed. It was not accessible to the public. The <br />Quorum Notification Statement was posted same day. My wife wanted to attend the meeting <br />discussion, but City Administrator Zikmund had informed me, by email, on June 13 that no <br />additional observers would be present at the meeting. At my meeting the opening statement <br />from the Mayor was to again ask for my resignation. At the close of the meeting, the Mayor <br />stated the council had decided to send a removal request letter to the Court. I witnessed no <br />discussion of the three members to concur with the mayor's statement. A digital recording of the <br />meeting is available for the Court if needed. <br />Page 3 of 13 <br />
