Guthmann <br />Ramsey County District Court <br />1 5 West Kellogg Boulevard, Room 130 <br />Saint Paul, MN 55102 <br />Re: In the Matter of t/ze Petition to Remove Brim Amundsen (62-CV-19-4965) <br />Dear Honorable Chief Judge Guthmann: <br />M y firm represents the City of Mounds View and its Charter Commission (collectively, the "City") <br />in the above-referenced matter, which is scheduled for a hearing on Monday, August 5, 2019. <br />Unless the intent of the hearing next week is to discuss how the case should proceed, the purpose <br />of this correspondence is to respectfully request any additional information or details regarding the <br />type of hearing that you wish to conduct on the aforementioned date, so as to allow the parties to <br />adequately prepare. <br />This matter stems from the district court's authority under Minn. Stat. 410.05, subd. 2 to remove <br />a charter commission member. Unfortunately, the statute does not provide any procedural <br />requirements or direction for removal and, in recognition of that, the City merely seeks any <br />information that you think might provide the parties an ability to properly prepare for the hearing. <br />Although court staff was very helpful in providing the parties with some general information, <br />knowing your expectations for the hearing will certainly allow the parties to adequately meet those <br />expectations. The City assumes that the hearing will not be an evidentiary hearing and, unless <br />otherwise instructed by Your Honor, the City will not be prepared to offer evidence or testimony <br />at this stage of the proceedings. <br />Thank you for both your time and consideration of this request. <br />1 <br />Very truly yo rs, <br />~'{ <br />David T.
